During the week of May 24, 2021, the General Policy Advisory Council met to discuss industry specific items for those that transport dangerous goods. Transport Canada (TC) raised an issue during the meetings that affects propane: its intent to propose a fee hike for highway tank facilities, startlingly similar to TSSA’s.  Instead of issuing a separate invoice for actual services rendered – as what is currently taking place – TC is intending to charge a flat rate.

The CSA Group has issued a recall alert. This recall involves specific StaRite and Mastertemp gas-fired pool heaters with a model number manufactured between December 22, 2020 and January 6, 2021. A connection in the heater can leak the combustible air-gas mixture, posing a fire hazard.

In September 2020, the federal government accepted Ontario’s emissions performance standards (EPS) program as an alternative to the federal output-based pricing system (OBPS) and will remove the application of the OBPS from Ontario facilities as of January 1, 2022.

Effective July 1, 2021, all repairs and alterations of BPVs, fittings and piping used for agricultural purposes must comply with Ontario Regulation 220/01: boilers and pressure vessels, under the Technical Standards and Safety Act, 2000.

Raymond Gouron, General Manager of the Association québécoise du propane, sent a letter to Carl Dufour, Director of the Greenhouse Gas Emissions Reduction Expertise Directorate with the Minister of Environment and Climate Change, expressing the industry's concerns on the province’s proposed oil heater regulations. The CPA’s requested revision to the B620 code regarding language pertaining to the CPA’s former equivalency certificate for the allowance of TC 331 or MC 331 highway tanks to maintain a 10-year B620 inspection interval, has been submitted, accepted and will be included in the next version of the code.

The CPA took the issue of significantly higher Technical Standards and Safety Authority fees for propane licensing and inspection imposed on May 1, 2021, directly to the minister responsible, the Honourable Lisa Thompson, in a meeting on June 4, 2021.

As announced previously, Transport Canada is providing a bulletin to inspectors directing them to no longer conduct queries on distributors who are currently required to provide a copy of a cylinder requalification document to new owners.

The annual TSSA Safety Awards Program was created to acknowledge individuals and organizations who work in TSSA’s regulated sectors and have made significant contributions to public safety in Ontario. Nominations for the 2021 TSSA Safety Awards Program are open until August 6, 2021. All nominations can be submitted via e-mail to safetyawards@tssa.org.

COVID-19

A number of Canadian provinces are now offering paid sick leave for eligible employees, for absences related to COVID-19. In accordance with these programs, employers are responsible for providing payment to employees during their period of COVID-19 sick leave, subject to reimbursement from various provincial governmental agencies. Click here to read Stikeman Elliott's high-level overview of the provincial COVID-19 leave entitlements, as well as how to seek employer reimbursement.

As previously announced, Ontario’s Stay-at-Home order expired on June 2, 2021. All other 1public health and workplace measures remain in place provincewide until Ontario enters Step One of the Roadmap to Reopen. They include limiting indoor gatherings to households only and outdoor gatherings to up to five people, maintaining a cap of 25 per cent capacity for essential retail where only certain goods are permitted to be sold, and restricting non-essential retail to curbside pickup and delivery only.
