California's Supply Chain Law: Impacts and Compliance

On Jan. 1, 2012, The California Transparency in Supply Chains Act (Supply Chains Act or law) went into effect, requiring certain businesses to publicly disclose what specific actions, if any, they have taken to eliminate slavery and human trafficking from their product supply chains. The disclosure must be posted on the company’s website and clearly linked from its homepage.

Senator Anthony Cannella (R-Ceres) held an informational hearing of the California Senate Committee on Agriculture, which he chairs. The hearing covered the impact the state’s regulations have on the agriculture industry. The February 24 hearing featured testimony from stakeholder industries on issues concerning AB 32 and the Irrigated Lands Conditional Waiver in the Central Coast. Assemblyman Luis Alejo (D-Salinas) joined Senator Cannella for part of the hearing.

Our two-and-a-half year effort to modernize gross vehicle weight limits was dealt a setback on February 2 when the House Transportation and Infrastructure Committee eliminated provisions in the Highway Bill that would have empowered states to allow the use of six-axle, single trailer trucks weighing up to 97,000 pounds on appropriate stretches of interstate highway.

The Legislative Analyst’s Office (LAO) has issued a report on the California Air Resources Board’s (CARB) greenhouse gas (GHG) cap-and-trade program that concentrates on the "policy trade-offs" that were made by the CARB in designing the program. The "policy trade-offs" referred to include the potential for emissions leakage and how to prevent it, the use of offset credits, steps taken to reduce volatility in allowance and offset credit pricing, oversight of both the auction and the market and the enforcement of cap-and-trade requirements on facilities subject to emission limits.
