What Happened: The U.S. District Court for the Eastern District of Texas has issued a nationwide preliminary injunction halting enforcement of the Corporate Transparency Act (CTA). This ruling means that AAHOA Members and other small business owners are not required to comply with the CTA's reporting requirements at this time.
 
The CTA, which was set to require millions of U.S. businesses to disclose "beneficial ownership" details to the Treasury Department by January 1, 2025, has been blocked as the Court found it exceeded Congress' regulatory powers.
 
What This Means for AAHOA Members
  • No Immediate Action Required: The Court's ruling means that businesses, including hotels owned by AAHOA Members, are not required to file beneficial ownership reports as previously mandated.
  • Temporary Relief: The CTA's requirements were criticized for being overly burdensome and costly for small businesses. This injunction relieves small businesses from the administrative and financial burdens the CTA would have imposed. AAHOA Chairman Miraj S. Patel described the court's decision as a "monumental win," protecting AAHOA Members from unnecessary compliance burdens for now.
  • Ongoing Legal Process: The ruling is preliminary, and the U.S. Department of Justice is expected to appeal. If the injunction is overturned, enforcement could resume.

Examining the Effect of Governmental Turnover on AAHOA’s Advocacy Efforts

Next month, Donald Trump will once again take the oath of the President of the United States as he becomes the 47th United States President. His election to the country’s highest office marked the culmination of a hugely contentious election cycle, which included numerous races for governor, seats in Congress, and many others. Now, a much clearer picture of the next four years is beginning to emerge from the fog of campaign season.

As the incoming administration starts to take shape and more is learned about policy priorities and legislative agendas across the country, AAHOA is paying close attention and developing its own strategies for addressing the hospitality industry’s most pressing concerns.

As Truist Securities wrote, “Overall U.S. RevPAR was -10.5% y/y for the week ending 11/30/2024, per STR/ CoStar, well below the prior week's result of +31.1% y/y and below the trailing 10- week average of +4.0% y/y. Last week's headline results were impacted by the calendar shift of Thanksgiving, which was one week later in 2024 vs. 2023. Understandably, there was limited business/group travel last week as most travel was leisure-focused. The Economy and Midscale chain scales had positive RevPAR last week which we attribute to the chain scales' leisure orientation plus continued hurricane-related demand. Upscale RevPAR: -17.9% y/y; Upper Midscale RevPAR: -7.9% y/y.”
