AAHOA Welcomes FTC Ruling Requiring Transparency in Lodging Pricing

What’s new: The Federal Trade Commission (FTC) has finalized the Rule on Unfair or Deceptive Fees, also known as the Junk Fees Rule, requiring upfront disclosure of total prices, including mandatory fees, for short-term lodging and live-ticket events.

Why it matters:

Ensures transparency for consumers, eliminating surprise fees like "resort" or "service" charges.
Levels the playing field for businesses with honest pricing practices.
Saves consumers an estimated 53 million hours and over $11 billion in the next decade.

Looking ahead: Effective April 2025, this rule aligns with AAHOA's advocacy for transparent pricing, complementing its support for the FEES Act earlier this year.

U.S. RevPAR +18.2% y/y Last Week; Hanukkah Shift Tailwind

As Truist Securities wrote, “Overall U.S. RevPAR was +18.2% y/y for the week ending 12/14/2024, per STR/ CoStar, above the prior week's result of +4.3% y/y and above the trailing 10-week average of +6.0% y/y. The timing of Hanukkah this year vs. last year was the driver of y/y strength. Last year, the eight nights of the holiday began on December 8, whereas they begin on December 25 this year. The timing shift was most evident in Group segment results, which were up 55.9% y/y. As we always note when there are exceptionally strong (or weak) Group segment results, a holiday shift is usually the cause. Upscale RevPAR: +18.4% y/y; Upper Midscale RevPAR: +14.9% y/y.”

A few dynamics impacted last week's results. Most impactful to us are two holiday calendar shifts. Chanukah was in last year's comp (starts on Christmas Day this year); there was strong weekend headline RevPAR y/y of ~+12-13%. Second is continued impact from Thanksgiving's shift later by a week – largely positive to Group last week post-holiday but with lagging business travel after the holiday. Finally, we see a continuation of hurricane-related displacement demand. Upscale RevPAR: +1.0% y/y; Upper Midscale RevPAR: +3.7% y/y”.

As Truist Securities wrote, “Overall U.S. RevPAR was -10.5% y/y for the week ending 11/30/2024, per STR/ CoStar, well below the prior week's result of +31.1% y/y and below the trailing 10- week average of +4.0% y/y. Last week's headline results were impacted by the calendar shift of Thanksgiving, which was one week later in 2024 vs. 2023. Understandably, there was limited business/group travel last week as most travel was leisure-focused. The Economy and Midscale chain scales had positive RevPAR last week which we attribute to the chain scales' leisure orientation plus continued hurricane-related demand. Upscale RevPAR: -17.9% y/y; Upper Midscale RevPAR: -7.9% y/y.”

Nationwide Injunction Halts Corporate Transparency Act: What AAHOA Members Need to Know

What Happened: The U.S. District Court for the Eastern District of Texas has issued a nationwide preliminary injunction halting enforcement of the Corporate Transparency Act (CTA). This ruling means that AAHOA Members and other small business owners are not required to comply with the CTA's reporting requirements at this time.

The CTA, which was set to require millions of U.S. businesses to disclose "beneficial ownership" details to the Treasury Department by January 1, 2025, has been blocked as the Court found it exceeded Congress' regulatory powers.

What This Means for AAHOA Members

No Immediate Action Required: The Court's ruling means that businesses, including hotels owned by AAHOA Members, are not required to file beneficial ownership reports as previously mandated.
Temporary Relief: The CTA's requirements were criticized for being overly burdensome and costly for small businesses. This injunction relieves small businesses from the administrative and financial burdens the CTA would have imposed. AAHOA Chairman Miraj S. Patel described the court's decision as a "monumental win," protecting AAHOA Members from unnecessary compliance burdens for now.
Ongoing Legal Process: The ruling is preliminary, and the U.S. Department of Justice is expected to appeal. If the injunction is overturned, enforcement could resume.

AAHOA Applauds Court Decision Invalidating 2024 DOL Overtime Rule

AAHOA applauds the decision by the U.S. District Court for the Eastern District of Texas invalidating the entirety of the U.S. Department of Labor's (DOL) 2024 Overtime Rule.

This ruling restores the minimum salary threshold to $35,568 and the threshold for highly compensated employees to $107,432, striking down both the July 1, 2024, increase and the planned January 1, 2025, increase. In his opinion, Judge Jordan emphasized that the 2024 Rule "effectively eliminates" the evaluation of an employee's duties in favor of a "salary-only test" and that automatic updates to the threshold every three years violate federal rulemaking requirements.

AAHOA strongly opposed the rule. The association estimated that the 2024 Overtime Rule would cost each member up to $18,000 over just six months, collectively burdening its 20,000 members with a staggering $360 million in additional expenses.

As Truist Securities wrote, “Overall U.S. RevPAR was +0.4% y/y for the week ending 11/16/2024, per STR/ CoStar, above the prior week's result of -3.5% y/y and below the trailing 10-week average of +2.1%. There are many moving pieces to last week's results that present a weaker net result than what we will expect for many of the following weeks of 4Q. Veterans Day's public holiday shifted into this Monday from the 2023 prior week Friday (net negative). Las Vegas and San Francisco had difficult comps given the lapping of the F1 race and APEC, respectively. Upscale RevPAR: +2.7% y/y; Upper Midscale RevPAR: +2.0% y/y.”

We assume some business travel was pulled into the week prior to Election Day, although Group RevPAR was somewhat surprisingly flattish. That said, there were tough y/y Group comps in some large markets such as Atlanta and Las Vegas. We treat the calendar shift of Halloween to a Thursday from a Tuesday as probably net-neutral to the weekly results. Last week's data also reflects the continued hurricane displacement demand impact to Houston (RevPAR +13% y/y) and Tampa (+45%). Upscale RevPAR: +4.5% y/y; Upper Midscale RevPAR: +4.1% y/y.”

As Truist Securities wrote, “Overall U.S. RevPAR was +9.3% y/y for the week ending 10/26/2024, per STR/ CoStar, above the prior week's result of +4.2% y/y and above the trailing 10-week average of +2.4%. Group/business travel demand rebounded last week due to a holiday calendar shift; the prior week included the Columbus Day holiday. Group RevPAR was +10.3% y/y last week. Other items that led to a strong headline RevPAR result: hurricane-related displacement demand continuing in markets such as Houston and Tampa and more broadly to Midscale (+9.4% RevPAR y/y) and Economy (+6.9%). Additionally, New Orleans RevPAR was +78% last week, aided by Taylor Swift concerts. Upscale RevPAR: +9.1% y/y; Upper Midscale RevPAR: +9.8% y/y.”

We previously highlighted that hurricane-related displacement could result in incremental demand for Midscale and Economy hotels, and that has proven to be the case in Florida (and continues in Houston). FEMA is offering lodging reimbursement for those impacted by Hurricanes Helene and Milton, as has been the case with past storms. This demand aids current RevPAR results but results in a difficult comp next year. Tampa RevPAR y/y was +33.2% last week; Houston was +21.6%. Upscale RevPAR: +3.7% y/y; Upper Midscale RevPAR: +4.0% y/y.”

AAHOA Expresses Disappointment Over Passage of New York City Council's Safe Hotels Act

What Happened: AAHOA is deeply disappointed by the New York City Council's decision to pass the Safe Hotels Act on Wednesday, October 23, despite recent revisions. While the exemption for hotels with fewer than 100 rooms offers relief to some, AAHOA remains concerned about the adverse effects of this legislation on the broader hotel industry, particularly minority-owned businesses. The revisions fail to address industry leaders' critical concerns throughout the legislative process.

Deeper Dive: The Safe Hotels Act (Int. No. 991-C) threatens to disrupt normal hotel operations and could increase costs. Hoteliers would be required to secure an additional operating license and ban the use of subcontractors for core functions such as housekeeping and front desk services. AAHOA believes the legislation still creates significant burdens for the industry.
