HUMAN RESOURCES LEGAL SERVICES AVAILABLE TO ACCG-IRMA MEMBERS

Personnel matters are always a challenge. Unfortunately, most employers must discipline or terminate an employee at some time. It may be a result of an improper action by the employee, or it may result from a change within the organization that necessitates the loss of a position or a reduction in force. One may also have questions about FMLA, LGBTQ, or other personnel issues that can be confusing. If the action taken is improper, an expensive claim or lawsuit may be the result. This likely means a lot of time involved in responding to EEOC complaints, justifying the decision that was made, and perhaps attendance at court proceedings. Significant time and expense can be at stake.
In 2016, ACCG-IRMA began offering Human Resources Legal Services to assist counties with personnel issues. Counties are encouraged to discuss potential firings or other personnel actions with an attorney before terminating an employee to ensure that the county is on solid legal ground and to help minimize claims and lawsuits than can result from such actions. Jarrard & Davis was selected to provide advice to member counties on behalf of ACCG-IRMA. They were selected not only because of their expertise in personnel law, but because they serve as the county attorney for a number of counties in Georgia and are familiar with the way counties operate. The Human Resources helpline is automatically provided to members of the ACCG-IRMA program, and there is no additional charge for the service. It has helped many counties avoid costly litigation arising out of claims that can result when employees are disciplined or terminated before the proper steps are taken and/or documented. The legal consultation is limited in scope and not intended to replace any of the services afforded by a county attorney, HR Department, or HR consulting firms.
The service has proved very beneficial. The number of successful claims against counties has dropped significantly, and those who have used the helpline are very complimentary of the service they received.
