The Association County Commissioners of Georgia (ACCG) is pleased to announce that Joseph "Joe" Scheuer joined the Association’s legal department on December 1, 2011.  Mr. Scheuer has served as Deputy Legislative Counsel in the Office of Legislative Counsel for the State of Georgia since 1980. 

"Joe brings tremendous experience and a depth of understanding of the Georgia Code as a result of his long and respected tenure with the Office of Legislative Counsel and will provide additional strength to our legislative advocacy efforts," said ACCG Executive Director Ross King.

As Deputy Legislative Counsel, Mr. Scheuer served as the senior attorney for the state legislature, providing expertise in the areas of state and local taxation and local government law.  He was responsible for rendering opinions regarding the constitutionality and legal effect of proposed legislation and existing statutes; drafting constitutional amendments, general and local legislation and committee reports; researching and providing information on state, county and municipal issues and policy questions; and reviewing and revising state agency regulations for compliance with state laws.  Furthermore, he was responsible for the publication of the Official Code of Georgia Annotated.  He is also a published author in a number of legal journals.    

Mr. Scheuer holds a Bachelor of Arts from Berry College and a Doctor of Jurisprudence from the University of Georgia School of Law.   He lives in Cherokee County.
 

Submit Immigration Reports by the End of the Year

Counties are required to submit two separate immigration reports, the E-Verify Public Contractor Compliance Report and the Public Benefit Report, by the end of the year in order to stay in compliance with Georgia’s immigration law.

The E-Verify Public Contractor Compliance Report must be submitted to the Department of Audits by December 31st.  The reporting period for this report is for contracts entered into from July 1, 2011 through November 30, 2011. This report will include the county’s E-Verify number and date of authorization, and the legal name, address, and E-Verify number of the contractor as well as the date of the contract between the contractor and the county. Although you can submit your report by mail, the Department of Audits would prefer to receive it electronically. You can request instructions on how to submit the report electronically by sending an email to HB_87@audits.ga.gov with the subject line "Request HB 87 Instructions."

To access the reporting website, go to the following page on the Department of Audits website.

Once you have accessed this page, click on "Compliance Report Template and Instructions" located under the Section 3 information. After clicking on that tab, you will land on the instructions page. The report form is located on a separate tab located to the left of the instructions tab labeled "Report Form." Review the general instructions located under the "Report Form Instructions" tab and send the email request to the Department of Audits for instructions on how to submit the report electronically. Once you receive the instructions on how to submit the report electronically, you will be able to complete and submit the report.

The Department of Audits has also sent an information packet on the new reporting requirement with a copy of the report format and instructions to each county. Please make sure that the person charged with completing and submitting the report for your county receives this information packet. 
 
The Public Benefits Report must be submitted to the Department of Community Affairs (DCA) by January 1, 2012.  This report will identify any public benefits administered by the county and a listing of each public benefit for which SAVE authorization for verification has not been received. ACCG and GMA have sought clarification about the second requirement from DCA. Until this issue is resolved, your county should submit the information that is currently requested by DCA, which includes the names of the applicants for which verification was not received.

A third report, the E-Verify Private Employer Report will need to be submitted starting on December 31, 2012. However, this report is not due this year. All three reports will be due on an annual basis thereafter.
