CCNA Update

The GAC was recently provided with the final draft of the CCNA language. During yesterday’s GAC call, we discussed the fact that it appears to be positive for the profession and fits within the parameters set by the Executive Committee at the Annual Conference. It does not raise the caps for continuing contracts, it reverses the AG opinion and provides that the projects must be listed in the solicitation rather than only in the contract itself, which is a further clarification over current law that provides for more transparency. Additionally, the draft caps the contracts at five years with a two year extension, which is lengthier than many of the contracts today, so it would not interfere with ongoing contracts. And lastly, it provides that firms cannot be required to provide competing price proposals. This is also a positive change. As such, the Chapter will be supporting this language. It is also supported by FICE and AWWA.

Trails

The Florida Greenways and Trails Council met recently and had a lengthy discussion regarding the Sun Trail program. The Department of Transportation (DOT) is still working on a framework for this program and will be taking public comment as they develop the program. Funds will not be programmed until there is a framework in place. The Council will be discussing regional priorities at its next meeting on December 14. It is expected that the Council will eventually rank the various regions in Florida and provide this information to DOT for use in making funding determinations. Additionally, trails that are on the Department of Environmental Protection (DEP) priority map will be funded, provided that the trails are also in the DOT work plan, and the Metropolitan Planning Organization (MPO) or local government has made funding the trails a priority.

Unlicensed Activity Fees

SB 294 by Senator Hays; HB 303 by Representative Burton

This bill prohibits the Department of Business and Professional Regulation (DBPR) from imposing a specified fee under certain circumstances. It has been provided to the GAC for review.

Playground Safety

SB 406 by Senator Sobel; No House companion to date

This bill requires certain new and existing playgrounds to comply with specified safety standards and guidelines. It also authorizes counties and municipalities to require permits and charge fees for the construction or renovation of certain playgrounds.
