Local Law 97
Status:
BOMA NY met with new Deputy Commissioner for Sustainability Laura Popa, Department of Buildings to discuss the following issues.
-Raised the concern re: smaller buildings being able to comply with LL 97
-Also raised the concern of supply chain issues and cost concerns surrounding implementing this legislation from owners’ perspectives.
-DOB is currently drafting a rule around what “good faith effort” for compliance is; potential release of draft rule in April.
-DOB is amendable to BOMA request for a webinar in the future to discuss compliance issues.
Councilmember Vickie Paladino introduced Int. 913-2023, which would delay all requirements and related penalties created by Local Law 97 pertaining to the reduction of greenhouse gas emissions by buildings by 7 years. Please note that this legislation was introduced by a member of the body’s Republican minority and likely won’t even get an initial public hearing.

Review new compliance rules this spring and schedule opportunity for DOB leadership to present to BOMA members.
Commercial Rent Tax
Status:
Boma New York met and partnered with the NYC Hospitality Alliance regarding the important issue of repealing the commercial rent tax.
Next Steps:
Plans to meet with Manhattan Chamber of Commerce; and the Majority Leader/Councilmember Keith Powers and Councilmember Gale Brewer (sponsors of the bill).
EV Legislation
Status:
In coordination with REBNY, BOMA New York submitted testimony regarding Int. 150, which amends the administrative code of the city of New York and the New York City building code, in relation to electric vehicle charging stations in open parking lots and parking garages.
Next Steps:
Ongoing negotiations with REBNY Gov Affairs team and other partner organizations to inform on rule making efforts.
E-Bike Batteries/Charging
Status:
Scheduling a meeting with City Council Fire & Emergency Management Committee Chair Ariola and the FDNY.
State of the City – Midtown Rezoning
Status:
In his State of the City address on 1/26/23, Mayor Adams mentioned that rezoning midtown was a priority. However, he did not share additional details beyond the general goal of targeting certain areas within manufacturing and commercial uses to be potentially rezoned for residential use.

Review more detailed rezoning and conversion plans when released and set up a conversation with BOMA NY and the NYC Planning Commission.
