Ontario – New Mining Act Regulation For Recovery of Residual Minerals and Metals

On November 28, 2024, the Province of Ontario announced that a new Mining Act "Recovery of Minerals” regulation would be implemented.

Accordingly to the Province, the new regulation will make it easier for the mining sector to recover residual metals and minerals from mine waste at operating, closed or abandoned mine sites. This regulation is apparently the first of its kind in Canada for the recovery of minerals while seeking to ensure health, safety and protection of the environment for recovery of minerals in tailings areas, near tailings dams, or in waste rock areas.

Ontario – New Conservation Authorities Act Regulation

On January 6, 2025 Ontario announced that a new Conservation Authorities Act regulation had been passed to specify the circumstances under which the Minister of Natural Resources may issue an order to make a permitting decision in place of a local conservation authority or undertake a review of a conservation authority permitting decision.

Hydro electric dam owners and operators will be interested to know that the based on consultation on the regulation proposal, the definition of provincial interest to which the Minister’s authority could apply was broadened to include "energy infrastructure."
