Legislative Update
The Association is gearing up for the 2025 legislative session, with a top priority being Medicaid rate increases. Kicking off our advocacy efforts have been two key meetings with the Speaker of the House (Representative Matt Ritter) and Senate President ProTempore (Senator Martin Looney).
 
After a promising meeting with Speaker Ritter on October 3rd, where Medicaid rates were stated as one of his two top priorities (the other being childcare), we met with Senate President Looney and his staff yesterday, October 16th. 
 
The Association will continue its strong advocacy efforts through the coming year and look to their members for ongoing support.

Vice President Kamala Harris released a plan on Tuesday proposing to extend Medicare coverage to home care for the first time. According to the Harris campaign, the proposed coverage would include:
  • At Home Services: Medicare enrollees will be independently evaluated by physicians or nurses as to whether seniors are unable to independently perform activities of daily living like bathing, eating, and going to the bathroom and/or face serious cognitive impairment. Aides will be designated by Medicare and can include any qualified home health aides, personal care attendants, or direct care workers recognized by their state.
  • Services Tailored to Fit Need: Medicare at Home recognizes that the vast majority of seniors with long-term care needs are still able to live in their homes with an average of 20 hours or less a week of care provided by a home care aide for daily activities such as bathing, eating, and cleaning. Medicare will design a plan that provides coverage for those of modest incomes with a sliding scale for cost-sharing for seniors with higher incomes.
  • Innovate and Engage with the Private Sector: This initiative will draw upon best practices across Medicare plans as well as the private sector to expand the home care workforce, partner with technology companies in areas such as remote patient monitoring and telehealth services, as well as other private sector partnerships.
  • Lift Up Care Workers: This initiative will provide care workers access to better wages, improve quality of care for seniors and those with disabilities, and treat our seniors with the dignity they deserve.

In a step towards addressing the growing workforce shortage in home care, new legislation has been introduced in Congress aimed at alleviating shortages that have left many vulnerable populations without care. This issue has become increasingly critical as the demand for home care services grows with an aging population and the desire for seniors to age in place.
 
The proposed legislation focuses on several key areas, including increasing funding for home care services, enhancing training programs for caregivers, and providing incentives for professionals to enter and remain in the field. These measures are designed to not only improve the working conditions and compensation for home care workers but also to ensure a stable and skilled workforce that can meet the needs of patients.

Delayed home health access for Medicare beneficiaries is increasingly raising alarms from the Centers for Medicare and Medicaid Services and the home health industry as providers place blame on staff shortages and the program's reimbursement rates.

“Opposed.” That was the one-word response a home health provider left for the Centers for Medicare & Medicaid Services’ (CMS) during the comment period on the 2025 home health proposed payment rule.
 
This comment was an anomaly, in terms of its brevity. While most respondents expressed similar sentiments, they chose to utilize more words to do so.
 
Overall, providers went into detail about the specific challenges they are facing in their market, and why the proposed payment rule would impact access to care.
