Proposed Rulemaking on Speed Limiting Devices

Late last week the Federal Motor Carrier Safety Administration (FMCSA) and the National Highway Traffic Safety Administration (NHTSA) rolled out their joint proposed rulemaking regarding speed limiting devices for trucks weighing over 26,000 GVWR.
The proposed standard would also require each vehicle, as manufactured and sold, to have its device set to a speed not greater than a specified speed and to be equipped with means of reading the vehicle’s current speed setting and the two previous speed settings. Under the proposal owners of the vehicle would be required to maintain the device. The proposal has not identified a specific speed that the device has to be set at.
