Prop 64 and FMCSA Guidance on Recreational and Medicinal Marijuana

We have received several inquiries about Proposition 64, the initiative to legalize recreational marijuana use which is on the ballot in November, and the potential ramifications for commercial drivers and drug and alcohol regulations. As this initiative may be successful, we wanted to circulate FMCSA’s guidance on changes to state marijuana laws to allow medicinal or recreational use of marijuana.
The FMCSA issued the following notices in 2009 on medicinal marijuana use and in 2012 on recreational marijuana use in states which allow such use. In summary, FMSCA regulations have not changed to accommodate existing changes in state laws.
