FMCSA Releases ELD Guidance on Transportation of Agricultural Commodities and Personal Conveyance

Yesterday, the FMCSA released clarifying regulatory guidance for transportation of agricultural commodities as well as additional guidance on "personal conveyance." 
 
The agricultural guidance clarified several hours of service related questions (i.e.: source of commodity, 150 air-mile radius, laden vehicles) that have been common with transporters of agricultural commodities, as defined in 395.2 . It’s important to note that the guidance did not address the specific definition of "agricultural commodity." Attached to this email is an FMCSA provided document that outlines the guidance. The regulatory guidance released on personal conveyance (PC) clarifies some circumstances as to when PC can and cannot be used. The guidance focuses on the reason the driver is operating a CMV while off-duty to determine if PC is applicable, regardless of whether the CMV is laden. Of particular interest, the guidance establishes that PC can include "time spent traveling to a nearby, reasonable, safe location to obtain required rest after loading or unloading.
