CTA Testifies in Opposition to Bill Codifying Dynamex Decision

Last week, Assembly Bill (AB) 5 was heard in the Assembly Labor Committee. AB 5 codifies the Dynamex decision into law, expanding the decision beyond wage orders. If passed, the owner-operator business model would effectively be eliminated within California.

CTA’s Director of Legislative Affairs, Matt Roman, testified in opposition to AB 5 on behalf of the California Trucking Association. During the hearing, Roman said, “These individuals have chosen to remain independent because of higher wages, greater freedom to their schedule, and the ability to build something for themselves.”

CTA is continuing discussions with labor and the author to see if there is a pathway to save the owner-operator business model. However, given the legislative uncertainty of AB 5, CTA is moving ahead with the lawsuit stating that the Dynamex decision is federally preempted.
