PAGA Reform Legislation Revived

Earlier this week as the Legislature continued to introduce new legislation, Assemblyman Vince Fong introduced AB 2016 as part of a continuing effort to revamp the Private Attorney General Act otherwise known as PAGA.  

Asm Fong’s measure would require that a notice given to the agency or employer would have to include a statement setting forth the relevant, legal contentions, and authorities supporting each alleged violation and an estimate of the number of current and former employees against whom the alleged violation(s) were committee and on whose behalf.

While not a complete fix, AB 2016 would give much more clarity on the violations being alleged.

CTA was previously part of a coalition to try and put a repeal of PAGA on the ballot, an effort which ultimately fell short after it was determined that a legislative route was preferable.
