Fight to Protect the Independent Contractor Business Model –Contribute to CTA’s Litigation Fund

Does your company utilize independent contractors? If yes, you may now be retroactively liable for wage and hour violations as a result of the Dynamex Decision and misclassification claims can cost your company up to $300,000 to $400,000 per driver. With approval from CTA’s Executive Committee, CTA filed a lawsuit in October 2018 seeking declaratory and injunctive relief from the Dynamex Decision. Ogletree Deakins, a top rated labor and employment law firm, will be representing us.

We have strong legal team and are confident about our litigation strategy, but the litigation will be costly and we won’t be able to see the litigation through without your financial support. Thank you to our members that have already stepped up and generously pledged and contributed to the litigation, but we need more support. We are asking fleets to contribute $1,000 per driver or $25,000 per company. We understand this is a large amount of money to ask for, but the contributions you make are an investment in preventing your business from costly litigation and harm. We can work out a personalized contribution plan that works for your company.

Contributions can be made out to the California Trucking Association, 4148 E. Commerce Way, Sacramento, CA 95834. (Please include “General Litigation Fund or Dynamex” in the memo or email, so the funds are properly accounted for). Major contributors will have an opportunity to be involved in the management and oversight of the litigation.
