Hot Bills: April Legislative Update

We have put together a sample of the bills CTA is following that includes position, author, bill description, and how the bill has performed through the committee process. If these bills are passed and signed into law, they would have a significant impact on labor, tax, and environmental regulations and your business operations. 

AB 321 - CTA's Position: Support 
A bill authored by Asm. Patterson that would exempt new trucks 6,000 pounds or more from sales and use tax until January 1, 2024. The trucks exempt would be purchased for use outside of California and would be delivered to the purchaser in California who would drive or move the vehicle outside the state within 30 or 75 days. The bill has has passed Assembly Revenue and Tax Committee and Assembly Appropriations Committee.

AB 371 - CTA's Position: Support 
A bill authored by Asm. Frazier that would require an economic analysis be completed with the Sustainable Freight Plan. The bill has passed the Assembly Transportation Committee. 

AB 443 - CTA's Position: Support 
A bill authored by Asm. Flora that would cap attorney’s fees in PAGA cases to no more than 25% of the gross judgement amount or settlement amount. The bill has failed to move out of Assembly Labor Committee.

AB 555 - CTA's Position: Oppose with the CalChamber Labor Coalition 
A bill authored by Asm. Gonzalez that would expand paid sick leave from 3 days to 5 days. The bill has passed the Assembly Labor Committee. 

AB 1191 - CTA's Position: Oppose with the CalChamber Labor Coalition Environmental and Business Interests at the Port of Oakland 
A bill authored by Asm. Bonta that would remove environmental protections of the Tidelands Trust from Howard Terminal to make way for a new stadium and housing projects. The bill has passed the Assembly Natural Resources and Assembly Local Government Committees. 

AB 1262 - CTA's Position: Support - Leading a Coalition of Business and Environmental Groups 
A bill authored by Asm. O'Donnell that would require 15% of Cap and Trade GGRF revenue to go towards medium and heavy duty incentives for near zero and zero emission trucks. The bill would also require the Sustainable Freight Plan to be refreshed every 5 years, to inform decisions on technology, and how incentive money should be spent. The bill has passed the Assembly Transportation and Assembly Natural Resources Committees. 

SB 44 - CTA's Position: Support 
A bill authored by Sen. Skinner that would require 10% of Cap and Trade GGRF revenue to go toward medium and heavy duty incentives for near zero and zero emission trucks. The policy mirrors AB 1262. The bill has passed Senate Environmental Quality and Senate Transportation Committees. CTA was neutral on the original measure as it had hard targets for emissions reductions, but with amendments in Senate Transportation, CTA has moved to support the bill. 

SB 210 - CTA's Position: Oppose Unless Amended
A bill authored by Sen. Leyva that would create a pilot smog check program for heavy duty trucks to be administered by CARB. The bill has passed Senate Environmental Quality and Senate Transportation Committees. Sen. Leyva has accepted all requested amendments, with the exception of removing the fee language which would give CARB unlimited fee authority to administer the program. 

SB 216 - CTA's Position: Support
A bill authored by Sen. Galgiani that would create a heavy-duty exchange truck program to replace older truck engines with alternative fuel engines through the existing Carl Moyer Program. The bill has passed Senate Environmental Quality and Senate Transportation Committees.
