CARB's rulemaking package establishes lower opacity limits for both the HDVIP and PSIP that heavy-duty vehicles must meet to operate in California. The amendments also establish smoke tester training requirements for individuals who perform smoke tests in the PSIP and a voluntary option to submit on-board diagnostics (OBD) data in lieu of performing an annual PSIP smoke opacity test for 2013 model year and newer engines.
CTA was actively involved throughout the rulemaking process and repeatedly expressed CTA member concerns with the rule including the burden of PSIP reporting requirements and testing requirements upon vehicle sale. PSIP reporting requirements and testing requirements upon vehicle sale were removed in December 2018.
The final rule was submitted to the Office of Administrative Law (OAL) on March 26, 2019. OAL approved the rulemaking and filed with the Secretary of State on May 8, 2019. The rule will become law on July 1, 2019.
