On December 31, 2019 United States District Judge Robert T. Benitez granted CTA’s request for a temporary restraining order enjoining enforcement of AB 5. The Court found that CTA met its burden for a temporary restraining order and enjoined the State from enforcing AB 5 as to any motor carrier operating in California, pending resolution of our motion for a preliminary injunction. The Court also found that CTA and the individual plaintiffs had standing. The Court based its ruling on the FAAAA and declined to address, at this time, our Dormant Commerce Clause challenge. The hearing on the motion for preliminary injunction is set for January 13, 2020. View the judge's order here
