The California State Court of Appeals issued a decision in People of the State of California v. Superior Court Los Angeles County. Of greatest interest is the Court’s view that California’s ABC Test is not preempted by the Federal Aviation Administration Authorization Act (FAAAA) and that motor carriers may comply with the business-to-business exemption as outlined in AB2257.
After 8+ hours of public testimony and discussion, the Cal/OSHA Standards Board unanimously adopted the COVID-19 Prevention Emergency Rule requiring, among other things, employers to implement and maintain a written COVID-19 Prevention Program, provide employees with PPE, and offer COVID-19 testing at no cost to all employees (during working hours) who had potential COVID-19 exposure in the workplace.
Since the start of the coronavirus pandemic through Nov. 12, 2020, the U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA) has issued 232 citations arising from inspections for violations relating to coronavirus, resulting in proposed penalties totaling $3,148,452. OSHA inspections have resulted in the agency citing employers for violations, including failures to implement a written respiratory protection program and record an injury or illness on OSHA recordkeeping forms, among other issues. In light of the recent rise in COVID-19 cases across California, Governor Gavin Newsom and the California Department of Public Health (CDPH) today announced a limited Stay at Home Order requiring generally that non-essential work, movement and gatherings stop between 10 PM and 5 AM in counties in the purple tier. The order will take effect at 10 PM Saturday, November 21 and remain in effect until 5 AM December 21. This is the same as the March Stay at Home Order, but applied only between 10 PM and 5 AM and only in purple tier counties that are seeing the highest rates of positive cases and hospitalizations.
California’s Paid Family Leave (PFL) program provides up to eight weeks of partial wage replacement benefits to your employees who take time off work to care for a seriously ill family member (child, parent, parent-in-law, grandparent, grandchild, sibling, spouse, or registered domestic partner) or to bond with a new child (by birth, adoption, or foster care placement). Effective January 1, 2021, PFL will expand to include a new claim type: Military Assist. This new claim type will provide wage replacement benefits to eligible California workers who need time off work to participate in a qualifying event as a result of a family member’s (spouse, registered domestic partner, parent, or child) military deployment to a foreign country. The Port of Long Beach has been named the best West Coast seaport in North America for the second consecutive year. The award was given Nov. 9 in Hong Kong at the 34th annual Asian Freight, Logistics and Supply Chain Awards, hosted by shipping trade publication Asia Cargo News.
