Rita L. Saenz has been appointed by Governor Newsom as the new EDD Director to lead the Department, after spending many years in various roles in both private business and state government. Please refer to the recent Press Release by the Governor on Director Saenz’s appointment.
The Small Business Administration (SBA) and Department of Treasury have released guidance for businesses reflecting the new round of Paycheck Protection Program (PPP) loan funding recently approved by Congress. SBA has reopened the Paycheck Protection Program (PPP) for first draw loans, and certain eligible borrowers that previously received a PPP loan are able to apply for a second draw PPP loan with the same general loan terms as their first draw loan.
As part of it's Advanced Clean Trucks regulation, CARB adopted a "large entity one-time reporting" requirement. You are required to report information to CARB if your entity operates a facility in California and it meets any of the following criteria:
- Had more than $50 million in revenues in 2019 from all related subsidiaries, subdivisions, or branches, and has at least one vehicle; or
- Owns 50 or more vehicles; or
- Dispatches 50 or more vehicles into or throughout California; or
- Are a government agency (federal, state, local, and municipalities) and have at least one vehicle
The Ninth Circuit Court of Appeals denied petitions for review of the Federal Motor Carrier Safety Administration (“FMCSA”)’s determination that federal law preempted California’s meal and rest break rules, as applied to drivers of property-carrying commercial motor vehicles who are subject to the FMCSA’s own rest break regulations. This means that the FMCSA's preemption determination is upheld for the time being. The industry's eyes will now turn to any changes in the agency's interpretation under the incoming Biden administration.
The California Supreme Court ruled that it's Dynamex decision applies retroactively to wage order claims pending at the time the decision was made final in April of 2018. Please note that this decision does not address retroactivity of claims brought outside of the scope of California wage orders (i.e. meal and rest, overtime, minimum wage).
