The Federal Motor Carrier Safety Administration (FMCSA) announced the extension of the current Emergency Declaration including multiple waivers related to COVID-19 that was set to expire August 31, 2021. The extended declaration will be effective from September 1 until November 30, 2021 unless terminated sooner. There have been changes to the declaration including additional commodities covered by the waiver, and new reporting requirements.
The declaration now only applies to §395.3, “Maximum Driving Time for Property-Carrying Vehicles.”
The extension provides regulatory relief to commercial motor vehicle operations providing direct assistance in support of emergency relief efforts related to COVID-19 and is limited to the transportation of:
1. Livestock and livestock feed;
2. Medical supplies and equipment related to the testing, diagnosis, and treatment of COVID-19;
3. Vaccines, constituent products, and medical supplies and equipment, including ancillary supplies/kits for the administration of vaccines, related to the prevention of COVID-19;
4. Supplies and equipment necessary for community safety, sanitation, and prevention of community transmission of COVID-19 such as masks, gloves, hand sanitizer, soap, and disinfectants; and,
5. Food, paper products, and other groceries for emergency restocking of distribution centers or stores;
6. Gasoline, diesel, jet fuel, and ethyl alcohol; and,
7. Supplies to assist individuals impacted by the consequences of the COVID-19 pandemic (e.g., building materials for individuals displaced or otherwise impacted as a result of the emergency).
Reporting Requirements
The notice directs motor carriers that voluntarily operate under the terms of this extension and amendment of Emergency Declaration No. 2020-002 to report within 5 days after the end of each month their reliance on the Declaration. To report, motor carriers will access their portal account at https://portal.fmcsa.dot.gov/login.
The California State Transportation Agency (CalSTA) indicated the temporary special permit that increases the maximum overweight total up to 88,000 pounds for transportation of certain agricultural products will be extended until December 30, 2021. CalSTA is in the process of updating the new application form and the permit website and should be available later this evening. All companies with a permit will need to reapply for the new permit.
Any drivers currently hauling over 80,000lbs are at risk of citation.
The permit applies only to overweight trucks hauling the following agricultural products: tomatoes, peaches, pears, grapes, onions, peppers, carrots, citrus, almonds, pistachios, walnuts, olives, pomegranates, rice, wheat, corn, safflower, and potatoes.
The special permit will be valid until December 30, 2021 and will be subject to certain conditions. A log of the overweight loads must be submitted every thirty days to Caltrans and the California Highway Patrol. The special permit only applies to state highways and does not apply to overweight trucks transporting agricultural goods on Interstates and local roads. Overweight trucks transporting agricultural products will have to get permits from local jurisdictions to travel on local roads. The California Air Resources Board (CARB) recently released their proposed regulatory language for the Advanced Clean Fleets rule. The released documents include the text of proposed regulation and cost assumptions associated with implementation. Staff are currently reviewing the documents and will be submitting public comment. Initial impression is that these draft regulations follow CARB staff's March proposal closely.

This course provides the necessary “hazardous materials employee” training for interstate and intrastate motor carriers transporting regulated hazardous materials, as prescribed by Code of Federal Regulations, Title 49 and California Code of Regulations, Title 13 requirements. This training is mandatory for office and dock workers, as well as drivers. The regulations require the initial training within 90-days of employment and recurrent training once every 3-years.
