Government Affairs Update
 
The California Air Resources Board (CARB) is hosting a series of workgroup meetings to discuss challenges and solutions for building fueling infrastructure to support growing zero-emission fleets in response to the proposed Advanced Clean Fleets (ACF) regulation.
 
The meetings are held in collaboration with the California Energy Commission (CEC), the California Public Utilities Commission (CPUC), and the Governor's Office of Business Administration and Economic Development (GO-Biz). Input from these discussions will inform the Advanced Clean Fleet regulatory development process.
 
The third meeting is scheduled for Wednesday, January 12, 2022, from 9:00 AM - 12:00 PM and will focus on Electricity and the Grid.
 
The 2022 CARGO PAC Reception will be held at the Annual Membership Conference on Thursday, January 20 from 5:30 – 7:00 PM at the Beer Garden in the Paris Hotel Las Vegas.
 
Special guests, Assemblymembers Heath Flora (R – Ripon) and Alex Villapudua (D- Stockton) will be joining us.  
 
The reception is complimentary to members that contributed to CARGO PAC in 2021.
 
If you did not contribute in 2021, you may still attend by making a minimum contribution of $250.

A few weeks back, CTA informed members of attempts by the San Francisco Municipal Transportation Agency (SFMTA) and the City of Inglewood to raise transportation fees, for both single trip and annual trip permits.
 
CTA recently heard back from both entities and after conferring with their respective city attorneys they agreed with our interpretation that this fee increase was against state law.
 
As a reminder cities and counties cannot charge more the state agencies, in this case Caltrans, to issue a single trip permit ($16.00) and an annual permit ($90.00).
 
The SFMTA proposed fee increase was a pretty significant increase of both single and annual permits and also included an future increase in 2023. CTA would like to thank longtime members Reeve Trucking, Heavy Transport and Taylor Heavy Hauling for bringing this to the association’s attention.

During the most recent California Transportation Permit Advisory Council (CTPAC) meeting, many CTA heavy-haul members expressed their frustrations with Caltrans’ inconsistency on applying its longtime policy of requiring inspection reports when submitting a transportation permit application.
 
Following the meeting, Caltrans notified industry via a memo that the policy applies to all applications that require an inspection report. Upon receiving the memo, many affected CTA members contacted us to express their concerns with the somewhat outdated policy and requested our assistance to have it modified.
 
Last week, CTA held a meeting with Caltrans, CHP and several of our heavy-haul members to discuss their concerns with the policy. Following the discussion, Caltrans agreed to consider a proposal that would revise and modernize the inspection report policy.
 
Over the next few weeks, CTA and its newly formed Inspection Report Work Group members will be drafting a proposal which will be presented to Caltrans for their consideration at the next CTPAC meeting.
 
CTA thanks the many members who participated in the meeting and provided great input and possible solutions.
 
Group Asks for Personal Conveyance Limits

The Commercial Vehicle Safety Alliance has petitioned FMCSA for a second time to more clearly define the term “personal conveyance” in hours of service regulations. It is asking the agency to add a maximum distance or time limit to the rules.

ATA is recruiting motor carriers of all types and sizes to participate in its latest Driver Compensation Study. Last conducted in 2020, the study will be used to comprehensively evaluate trends in driver compensation. 
 
Previous studies covered data from over 140,000 employee drivers and nearly 17,000 independent contractors, with data broken down by For-Hire TL carriers, LTL carriers and Private fleets. Survey participants will receive the comprehensive Driver Compensation Study for $100 ($1,500 for non-participants), a free executive summary prior to the release of the report and an invitation to a participant-only, free of charge webinar hosted by ATA Chief Economist Bob Costello to discuss the results of the study and answer questions. This year’s Driver Compensation Study will be released in the second quarter of 2022. All data will be held in the strictest of confidence and no individual company data will be released. Only industry and sector aggregate data will be reported.
