Government Affairs Update
 
Join CTA’s Government Affairs Team as they address the bills that came out of the 2021-2022 Legislative Seesion during our End-of-Session Webinar.
 
Learn what bills passed, which ones failed, and what’s coming in the future that could impact goods movement in California.

On September 9, the California Trucking Association and its counsel John Kinsey from the law firm Wanger Jones Halsley filed for injunctive relief against the California Air Resources Board (CARB) for incorporating a fee to the Trailer Refrigeration Unit (TRU) regulation without legislative authority.
 
The TRU regulation passed by CARB requires truck TRU operators to pay a $23 fee per zero-emission TRU or $45 per diesel TRU every 3 years.
 
CTA raised concerns during the regulatory process that CARB lacks the authority to establish fees when a new program is created without explicit legislative intent.

We invite all our members to contribute to this effort. Any legal financial support received shall be reimbursed in proportion to the amount contributed should our attorney fees are entirely or partially recovered in legal action.
The Federal Motor Carrier Safety Administration posted the 2023 United Carrier Registration fee schedule. 
 
The proposal includes a 31% decrease in UCR rates given the excess funds the plan has collected the past few years.
 
 The reduction in annual registration fees would be between $18 and $17,688 per entity, depending on the applicable fee bracket based on the number of vehicles owned or operated. 

The registration portal for 2023 payment of fees will open October 1 of this year.
 
Please join the California Air Resources Board and the California Trucking Association for a joint webinar to discuss the proposed Advanced Clean Fleets (ACF) regulation on Thursday, September 15 from 3:30 – 5:00 PM via Zoom. The ACF regulation will require fleets to turnover their trucks from diesel to zero-emission vehicles.
 
The regulation affects fleets in the drayage sector and an entity that meets the qualification of a “High Priority Fleet.” Any fleet that operates at a port will be subject to the ACF regulation regardless of fleet size. A “High Priority Fleet” is defined as an entity with 50 or more vehicles or an entity with annual revenue of $50 million or more a year. The regulation will go before the Air Resource Board for a vote on October 27, 2022.
 
The CARB team will review the ACF regulation and will take questions and answers at the end of the webinar.

It's that time of year when CTA begins to make preparations for 2023 and therefore it is time to advise its membership about the process regarding the annual election of Unit and Conference Officers and Unit Directors and of Statewide Officers.
 
Each member who is interested in serving as a Unit or Conference Officer or Unit Director should contact their respective Unit or Conference chairperson and indicate their interest. This contact can be by phone or email and should be done as soon as possible.
 
Each Unit and Conference should confirm their ballot by September 30 to elect its 2023 Officers (Chairperson, Vice Chairperson, Treasurer and Secretary) and Unit Directors. CTA staff will send ballots via email with voting to commence on October 14.

Do you have a written Drug & Alcohol Policy?  Do you know what your employee and supervisor training responsibilities are?
 
The Federal Motor Carrier Safety Administration’s (FMCSA) controlled substance and alcohol testing regulations are in place to protect the safety of the traveling public. Public safety is best served if drivers are aware of the effects of alcohol and controlled substances on health, safety, and the work environment. Educating drivers and training supervisors are essential for these programs to be effective, and employers are required to provide educational materials for drivers and training for supervisors prior to the start of testing, respectively.
 
The FMCSA regulations require that you develop a written policy on controlled substances use and alcohol misuse in the workplace and that the policy be provided to every driver identifies the required content of the materials to be made available to each driver and requires the employer to maintain a statement signed by each employee certifying receipt of the policy/educational materials.
 
Additionally, employers must provide training to all persons who supervise drivers subject to the regulations. The purpose of this training is to enable supervisors to determine whether reasonable suspicion exists to require a driver to undergo testing described. It must include at least 60 minutes of training on alcohol misuse and 60 minutes on controlled substances use (120 minutes total).
