The American Transportation Research Institute (ATRI) has issued a call for motor carriers and drivers to participate in their Predatory Towing Survey.
Predatory towing is any incident in which a tow truck operator egregiously overcharges, illegally seizes, damages by use of improper equipment, or withholds release of a truck and/or cargo. Recognizing its persistent negative impact on the industry, ATRI’s Research Advisory Committee (RAC) identified the need to better understand this problem as a top research priority earlier this year.
Over the years the CTA has addressed these types of issues through the Tow Service Advisory Agreement Committee. CTA also ran legislation that codified the requirements for participation in the Rotation Tow Program that CHP dispatches in response to accidents on the freeways.
The short survey asks fleets to share information including:
• Which types of predatory towing they deal with most frequently?
• What fees or delays they consider predatory?
• Which states they have encountered predatory tows?
It also seeks participants for a second round of more detailed data collection that will allow ATRI to quantify the frequency and operational impact of each type of predatory event.
All data collected will be kept completely confidential.
We invite all CTA members to take part of this important survey.
Randy Boyer of Nossaman LLP law firm presented "New Privacy Laws for Employers Take Effect January 1: Carriers’ Obligations and Drivers’ Rights Under the California Privacy Rights Act".
Beginning January 1, 2023, the consumer privacy protections created by the California Consumer Privacy Act and the California Privacy Rights Act will begin to operate within employment relationships. During this webinar, Randy provided an overview of the basic privacy and data security obligations motor carriers have regarding the driver information they collect, store and use regarding their drivers and the new rights drivers have with respect to controlling that information.
If you were unable to attend, you can watch a recording of the webinar:

Created by CTA members, the TUFSOB Scholarship Program came about at the 1992 Annual Membership Conference at the Hotel de Coronado in San Diego. The TUFSOB program was the brainchild of Bud Wallace (Cascade Drayage & Warehousing, Inc.), along with Joe Nievez (Quikway Trucking Company), Connie Garcin (Garcin & Associates), and Bob Crites (Condor Freight Lines, Inc.). These four came together, writing out their plan on a cocktail napkin, and implemented a way to raise funds and award grants to trucking's next generation.
Scholarship awards go towards high school graduates entering college, as well those continuing their college education. The TUFSOB program also supports those that wish to go to trade schools, as well as adults wishing to go to college that are sponsored by a member can also qualify for subsidies. Anyone that supports the trucking industry is considered, as long as they are sponsored by a CTA member company.
Proceeds from The TUFSOB (Truckers United Fraternity Super Offspring of the Boss) Golf Tournament go to build a scholarship fund that will make direct grants to children of those involved in the California trucking industry that are pursuing a higher education.
