The 5th Wheel
CTA in Action: Government Affairs Update
As you may have heard in recent days, legislators in California attempted to pursue a multi-billion dollar transportation funding bill leading up to a November 30th deadline that they needed to meet. Although the funding package was ultimately unsuccessful, following is a recap describing CTA’s advocacy activities during the past few weeks.

Compliance and Regulatory News
Back in 2014 the FMCSA rescinded the requirement that commercial motor vehicle (CMV) drivers operating in interstate commerce, except drivers of passenger-carrying CMVs, submit, and motor carriers retain, DVIRs when the driver has neither found nor been made aware of any vehicle defects or deficiencies. As you know California is not an automatic adoption of federal safety regulations as it has to go through regulatory process and or has up to 3 years to implement the regulation.
Yesterday, the U.S. District Court for the Eastern District of Texas issued an order blocking the December 1, 2016 effective date for the U.S. Department of Labor's Final Rule raising the salary threshold for exempt status. The Court ruled that the plaintiffs in the case (21 states and a variety of business groups) had demonstrated a likelihood of success in their lawsuit as well as irreparable financial harm if the Final Rule went into effect on December 1. The Court's ruling does not eliminate the Final Rule, but indefinitely delays the effective date while the case proceeds to a trial on the merits.

The effect of this injunction is the preservation of what is currently allowed. Until there is a further ruling by the Court, employers may continue to rely on the current $455 per week salary threshold for exempt status.

Every winter season creates challenges for our industry and the trucks that have to travel over California's high elevation mountain passes in order to make their deliveries. With the 2016-2017 winter months rapidly approaching, I'd like to call your attention to the Pusher Truck Program, one of the many CTA member benefits that makes a difference for hundreds of trucking companies each year as they pass the tough mountain climb on Interstate 80.

CTA Highlights

Nicole Toms, Events Coordinator

Start Date: March 2016
Department: Events

Nicole is one of the newest members to join the CTA staff. She works with the Director of Events and assists in the planning and coordinating of CTA’s Annual Membership Conference, 3 safety awards programs, and the California Truck Driving Championships. She communicates with member companies to get them involved and interested in upcoming and future events. She also works with members to secure sponsorships, because without our members’ participation and dedication, CTA wouldn’t be able to organize such successful events.

What three traits define you?
Hard-working, dependable and motivated.

What is your personal philosophy?
Make sure you find something positive about each day, even on the most challenging and tough days. Don’t let a day go by without a positive note.

Tell us two things most people don’t know about you?
I have spent the last year and a half fixing and updating my 67 year old house, and have watched it go from a dark, gloomy house, to a bright and cheery home. When I’m not working on or planning a new house project, I’m hanging out with my boyfriend, dog and cat.

What aspect of your role do you enjoy the most?
I really like seeing an event come together! I love the planning process of gathering information and sending it out to our members to get them excited about the events we have and then getting to see the members and drivers at those events. I think being able to see the whole progression from beginning to end has to be the most exciting and rewarding part of this role.
