CTA in Action: Government Affairs Update
The end of May brought the first half of the legislative year, known as the House of Origin Deadline, to a close. The deadline brought some good news and bad news for businesses around the state. AB 2841 (Gonzalez Fletcher) which would have expanded California’s mandatory paid sick leave law from 3 days to 5 days was "held under submission" in the Assembly Appropriations, essentially killing the bill for the year.
Compliance and Regulatory News
Yesterday, the FMCSA released clarifying regulatory guidance for transportation of agricultural commodities as well as additional guidance on "personal conveyance." The agricultural guidance clarified several hours of service related questions (i.e.: source of commodity, 150 air-mile radius, laden vehicles) that have been common with transporters of agricultural commodities, as defined in 395.2.
California sales and use tax generally applies to motor carrier rolling stock. However, the state has a somewhat complicated regulatory method by which a carrier can get a use tax exemption on equipment on which it takes delivery outside the state, which it first uses outside the state, and, if it brings the equipment into California within a year of purchase, more than half the miles that equipment travels during the following six months is in interstate or foreign commerce.
