CTA in Action: Government Affairs Update
The California Office of Administrative Law (OAL) has completed its review of the (interstate) Electronic Logging Device (ELD) rule. Effective October 1st the California Highway Patrol (CHP) will begin issuing citations for interstate carriers who are not in compliance with the rule. The enforcement of the ELD rule for (purely) intrastate operators is going to take a little longer than planned.
Yesterday, the Pipeline and Hazardous Materials Safety Administration (PHMSA) of the U.S. Department of Transportation released their decision in response to the preemption application submitted by National Tank Truck Carriers, Inc. (NTTC) and authored by the Scopelitis Law Firm. The application made the argument that drivers transporting hazardous materials (interstate or intrastate) should be subject to Federal meal and rest break laws...
In response to CTA’s engagement with the City of Norwalk regarding their cost to obtain a transportation fee, the City recently contacted CTA and informed us that they will be revising their transportation permit fee to the state mandated fee of $16.00. The City Attorney for Norwalk reviewed CTA’s letter and confirmed that the city is not allowed to charge more than what is allowed by law.
Compliance and Regulatory News
In August, the FMCSA published an Advance Notice of Proposed Rulemaking (ANPRM) seeking public comment on revising current Hours-of-Service Regulations for Interstate Truck Drivers. The formal notice was published on August 23rd. FMCSA received requests for an extension to the comment period from a number of organizations.
Last week, the Pipeline and Hazardous Materials Safety Administration (PHMSA) granted the National Tank Truck Carriers’ (NTTC) petition and preempted California’s meal and rest break laws as applied to hazardous material loads. PHMSA found that California’s meal and rest break laws regulate hazmat transportation and are inconsistent with Hazardous Materials Regulations.
New trucks entering service at the Port of Long Beach and the Port of Los Angeles as of Oct. 1, 2018, must be model year 2014 or newer, as the San Pedro Bay ports move forward with efforts to improve air quality and reduce the health impacts of air pollution. As part of the Clean Trucks Program, all trucks going into marine terminals in the two ports must be on the Port Drayage Truck Registry (PDTR).
