CTA in Action: Government Affairs Update
Owner-operators are facing extinction because of the recent California Supreme Court decision known as Dynamex. If your company utilizes owner-operators or subhaulers, you may now be retroactively liable for wage and hour violations. Misclassification claims can cost your company up to $300,000 to $400,000 per driver. CTA has filed a lawsuit in the U.S. Southern District Court seeking declaratory and injunctive relief against the Dynamex Decision and we will not be able to defeat the Dynamex Decision without your help.

American Logistics Aid Network (ALAN) is seeking donated transportation from Omaha NE to somewhere near Butte County. They anticipate 6 shipments in the next 2 weeks. 5 of them will be LTL (probably 7 pallets each) and 1 full truckload. The drivers will be primarily delivering cleaning supplies and some school supplies. During Brake Safety Week, Sept. 16-22, 2018, enforcement personnel in 57 jurisdictions throughout Canada and the United States conducted 35,080 inspections on commercial motor vehicles and captured and reported data on brake violations. The majority of vehicles inspected did not have any brake-related out-of-service conditions; however, inspectors found critical vehicle inspection items in the brake systems of 4,955 (14.1 percent) of the vehicles inspected and placed those vehicles out of service until the condition(s) could be corrected. Help Desk - FAQ's

FMCSA has published a list of FAQs related to their June 2018 release of personal conveyance guidance. FMCSA has provided answers to a series of Frequently Asked Questions to assist the industry and law enforcement in the application of the guidance.

Those questions can be found here. The guidance clarifies that Personal Conveyance is the movement of a commercial motor vehicle for personal use while off-duty and that a CMV may be used for personal conveyance even if it is laden, since the load is not being transported for the commercial benefit of the motor carrier at that time. FMCSA further stated that personal conveyance does not reduce a driver’s or motor carrier’s responsibility to operate a CMV safely, and motor carriers can establish personal conveyance limitations either within the scope of, or more restrictive than, the guidance provided.

Saturday, November 3, professional truck driver Robert St. John of Devine Intermodal was named Northern California’s Truck Driver of the Year at California Trucking Association’s Annual Driver of the Month/Driver of the Year Awards Banquet at the Hilton Arden West in Sacramento, CA. Mr. Robert St. John is a line driver with a career of over 28 years of commercial driving. He is 2.5 million miles accident and citation free. Robert is Devine’s Lead Driver Trainer. He participates in every event asked of him. He has brought his truck and expertise to multiple CTA training events. Robert has put over two and a half million miles on California roadways without a single collision.
