CTA in Action: Government Affairs Update
The California Transportation Permit Advisory Council (CTPAC) was held in April during the Specialized Carriers and Rigging Association (SC&RA) Conference at the Omni LaCosta Resort in Carlsbad. This year's CTPAC meeting had a huge increase in attendance. Over 50 heavy specialized carrier companies, CHP and Caltrans representatives were in attendance. In addition to the regular updates on current proposals and a review from Caltrans HQ, the CTPAC group determined that they will be putting forth a proposal to expedite equipment inspections. The propsoal could lead to revising the previous "virtual inspection" proposal for Caltrans to consider.
CARB staff released a white paper in April to respond to engine manufacturers requests for feedback regarding NOx requirements for Model Year (MY) 2022 and newer engines. Engine manufacturers are preparing their design and development plans to meet Phase 2 Greenhouse House Gas (GHG) requirements and want feedback from CARB on proposed NOx requirements, so they can include in their design and development plans.

On Friday, May 3, 2019, the Central District of California entered an order dismissing the meal and rest break claims of the plaintiff and absent class based on the December 28, 2018 decision from the FMCSA preempting the California meal and rest break rules as they apply to interstate drivers. See Ayala v. U.S. Xpress Enterprises, Inc. et al., Case No. EDCV 16-137-GW(KKx). Despite the plaintiff’s challenges to the FMCSA’s decision, the district court reasoned that it lacked authority to make any determination regarding the merits of the FMCSA’s decision. It could only enforce it.

The Federal Motor Carrier Safety Administration has slated publication of its notice of proposed rulemaking on changes to the Hours of Service rule for June 7. FMCSA also advised that it plans to then take comments on the NPRM until July 26. Those dates are per the latest “Significant Rulemaking Report,” posted monthly by the Department of Transportation, and are not legally binding. Read full article Unit News and Events
