CTA in Action: Government Affairs Update
Because of the continuing negotiations around AB 5 the hearing time has not been solidified. The Senate Labor Committee will convene at 9:30 am to hear bills. However, there is a chance AB 5 will be heard at 12 pm in a special order of business the same day. Given these changing dynamics, it is best to arrive at 9 am before the main committee will begin.
Assembly Bill (AB) 5, the bill that would codify the Dynamex Decision into law, is currently in the Senate. The bill is going through the committee process where a final decision will be made before September 13th on whether the bill becomes a law. AB 5 is the #1 Priority of the Labor Federation and if the bill passes it will put an end to the owner operator business model. It is imperative that Senators hear from you, their constituents, on AB 5, so they can know how the bill will impact the trucking industry and Owner Operators in their district. The introduction of electronic logging devices and their ability to accurately record hours-of-service (HOS) compliance for drivers of commercial motor vehicles (CMVs) have prompted numerous requests from Congress and the public for FMCSA to consider revising certain HOS provisions. In order to create a proposed rule that would fit the needs of the industry, FMCSA sought input from the public last year on proposed HOS changes. FMCSA received over 5200 public comments. FMCSA has gone through the comments and feedback they have received and are projecting that they will release their proposal to alter federal hours of service regulations on July 31. Caltrans is temporarily reducing the length of the High Occupancy Vehicle (HOV) lane on westbound Interstate 80 (I-80) in Fairfield. The HOV lane will now temporarily end at the Abernathy Road on-ramp to WB Interstate 80. The temporary reduction will accommodate work on the nearby Dan Wilson Creek Bridge in Fairfield from July 8 through October 2019.
