CTA in Action: Government Affairs Update
There is an increase in the number of third-party lawsuits targeting facilities operating under the California Industrial General Permit (IGP) for storm water, including members of the California Trucking Association. This memorandum outlines a few of the more common allegations made against transportation facilities and provides suggestions to CTA members that might reduce the risk of these often frivolous but still costly lawsuits.

If your company utilizes owner-operators or subhaulers, you may now be retroactively liable for wage and hour violations. Misclassification claims can cost your company up to $300,000 to $400,000 per driver. We are asking fleets to contribute $1,000 per driver or $25,000 per company, which is a fraction of the potential liability created by Dynamex. Check contributions can be made out to: “California Trucking Association” and mailed to CTA at 4148 E. Commerce Way, Sacramento, CA 95834. Anyone can contribute to the litigation fund. The Federal Motor Carrier Safety Administration (FMCSA) has opened registration for its Drug & Alcohol Clearinghouse. Motor carriers whose drivers are subject to the FMCSA’s drug and alcohol testing regulations must register with and begin using the Clearinghouse by January 6, 2020, though carriers should consider registering sooner rather than later. Once it becomes operational in January, the Clearinghouse will serve as a central repository for drug and alcohol program violations, including positive test results, and return-to-duty status for commercial drivers.

Junior League of Sacramento is looking for trucking companies that want to participate and display a truck in their fourth annual Touch-A-Truck Event. This educational community event provides hands-on opportunities for children and their families to see and touch the trucks and machinery used in our communities, and to meet the heroes that work on these machines. Companies can participate by: Providing a truck for the event Providing a sponsorship for the event Event Details: Touch-A-Truck is the primary fundraiser for JLS in their mission to develop women leaders, promote voluntarism, and improve our community. Specifically they are focusing on empowering girls to be confident leaders through programming centered on self-esteem, character development, and educational achievement.
