Truck Tech 2020 and Beyond!

Benitez granted CTA’s request for a temporary restraining order enjoining enforcement of AB 5. The Court found that CTA met its burden for a temporary restraining order and enjoined the State from enforcing AB 5 as to any motor carrier operating in California, pending resolution of our motion for a preliminary injunction. The Court also found that CTA and the individual plaintiffs had standing. The Court based its ruling on the FAAAA and declined to address, at this time, our Dormant Commerce Clause challenge. The hearing on the motion for preliminary injunction is set for January 13, 2020. View the judge's order here Transport Topics Online: Federal Judge Issues TRO Against Enforcement of California AB 5 On December 29, 2019, just days before AB 51 was to go into effect, a federal judge granted a temporary restraining order (“TRO”) to enjoin enforcement. The new law, which was set to go into effect on January 1, 2020, would outlaw mandatory arbitration agreements with employees and prohibit arbitration agreements that would require individuals to take affirmative action to be excluded from arbitration. Judge Kimberly Mueller concluded that it would be disruptive if the statute went into effect briefly and was later overturned. Up to $20 million in clean transportation funding is reserved for warehouse, distribution and logistics center operations within the South Coast Air Quality Management District portions of Riverside and San Bernardino Counties. Projects can be eligible for funding assistance if implemented in advance of regulatory requirements and/or if they go “above and beyond” future air quality obligations. Facility owners and operators can submit project proposals to the Mobile Source Air Pollution Reduction Committee (MSRC) by February 21, 2020 to be considered for assistance from the MSRC. At the Fauquier Livestock Exchange, U.S. Environmental Protection Agency (EPA) Administrator Andrew Wheeler followed up on his November 2018 announcement and took concrete steps to advance the Cleaner Trucks Initiative (CTI). Joined by U.S. Representative Denver Riggleman (VA-05) and a variety of stakeholders, the CTI rulemaking will establish new, more stringent emission standards for oxides of nitrogen (NOx) and other pollutants for highway heavy-duty engines. Beginning January 1, 2020 the sales and use tax exemption in Revenue and Taxation Code (RTC) 6388.5, which previously only applied to certain trailers and semitrailers, was expanded to apply to certain new, used, and remanufactured trucks. The expanded sales and use tax exemption will be operative through December 31, 2023. To meet the documentation requirements, complete this form and submit it to the manufacturer, remanufacturer or dealer of the truck or trailer no later than 30 days from the date the truck or trailer is taken outside California.
