SCOTUS Overturns Chevron Doctrine, Limiting Federal Agency Reach

The U.S. Supreme Court overturned the Chevron doctrine on Friday in Loper Bright Enterprises et. al. v. Raimondo, Secretary of Commerce, et. al., in a blow to federal agencies.

The decision to nix Chevron could have massive implications for law enforcement by regulatory entities such as the U.S. Department of Labor, the U.S. Equal Employment Opportunity Commission, the National Labor Relations Board and the Office for Federal Contract Compliance Programs. - Construction Dive

Fed Has Ability to Lower Borrowing Costs Without Rate Cuts

The Federal Reserve has revised expectations for interest-rate cuts in 2024 to one from three, but the central bank has other, more subtle tools that could decrease rates to benefit businesses and households. The Fed can sway rates by communicating intentions, even without cutting its base rate. The yield on the 10-year Treasury has a strong influence on long-term loans and the yield declined from 4.7% in late April to 4.33% after the Fed's latest rate decision. Any further moves could affect conditions for borrowers. - The Wall Street Journal

The Associated General Contractors of America, along with the U.S. Chamber of Commerce and a coalition of business groups, filed a lawsuit in the Western District of Texas, Waco Division against the Occupational Safety and Health Administration. The lawsuit challenges the agency’s new “walkaround” rule, which forces contractors to let potentially anyone, regardless of safety training, construction experience or intent to accompany a federal safety inspector on a jobsite. - AGC National

ABC: Nonresidential Construction Spending Slips 0.3% in April, Remains Near Record High

June 4, 2024 -- Industry News

National nonresidential construction spending decreased 0.3% in April, according to an Associated Builders and Contractors analysis of recent data published by the U.S. Census Bureau. On a seasonally adjusted annualized basis, nonresidential spending totaled $1.20 trillion.

Spending was down on a monthly basis in 10 of the 16 nonresidential subcategories. Private nonresidential spending decreased 0.3%, while public nonresidential construction spending was down 0.2% in April. - ABC National

The construction industry added 9,000 jobs on net in April, according to an Associated Builders and Contractors analysis of data released today by the U.S. Bureau of Labor Statistics. On a year-over-year basis, industry employment has increased by 258,000 jobs, an increase of 3.2%.

Nonresidential construction employment increased by 7,800 positions on net, with growth registered in all three major subcategories. Nonresidential specialty trade added the most jobs, growing by 6,600 positions. Nonresidential building and heavy and civil engineering added 900 and 300 jobs, respectively. - ABC National

ABC’s Construction Backlog Indicator Rebounds in March, Contractor Confidence Improves

Associated Builders and Contractors reported today that its Construction Backlog Indicator increased to 8.2 months in March from 8.1 months in February, according to an ABC member survey conducted March 20 to April 3. The reading is down 0.5 months from March 2023. ABC’s Construction Confidence Index readings for sales, profit margins and staffing levels increased in March. All three readings remain above the threshold of 50, indicating expectations for growth over the next six months. - ABC National

OSHA Heat Standard Is Coming Soon

March 20, 2024 -- Industry News

On April 24, OSHA plans to consult the Advisory Committee on Construction Safety and Health (ACCSH) on its proposed regulatory framework for the Heat Injury and Illness Prevention in Outdoor and Indoor Work Settings rule.

The ACCSH meeting is open to members of the public and will be announced in the Federal Register at least 15 days prior to the scheduled meeting. AGC will share the meeting details as soon as they become available. The meeting details will also be posted on the ACCSH webpage.

AGC encourages all members to participate in the meeting to learn more about how OSHA plans to regulate heat in construction. If interested, members of the public can also register to offer comments. - AGC National

UTA Raising Funds for Professor Michael Fairchild Memorial Endowed Scholarship

The Civil Engineering Department at The University of Texas at Arlington is raising funds to establish a scholarship endowment in memory of former Professor Michael Fairchild, who passed away in December 2023. The Professor Michael Fairchild Memorial Endowed Scholarship will support undergraduate construction management students with academic merit and financial need and will be a fitting tribute to Mike’s commitment to educating future generations of construction management professionals.

US Led Record-High Global Hotel Construction Pipeline in Q4

The U.S. led all other countries with the largest hotel construction pipeline worldwide, reaching a record 5,964 projects, or 693,963 rooms. Dallas and Atlanta led other global markets with the largest hotel construction pipelines. Lodging Econometrics previously forecasted continued pipeline growth across U.S. markets in 2024, bolstered by “less expensive borrowing costs” that will provide “long-awaited relief on interest rates.” - Construction Dive

Team Selected for $855M Dallas Airport Terminal Build

A group representing some of the country’s largest contractors has landed a contract to build Dallas-Fort Worth International Airport’s $855 million Terminal F Concourse and Skylink Station project. Innovation Next+ is led by Atlanta-based Archer Western Construction, a subsidiary of Chicago-based Walsh Construction. ABC Unveils AI Resource Guide for Contractors

Associated Builders and Contractors announced it has released an artificial intelligence technology guide for the construction community, which includes definitions, construction use cases and considerations. The purpose of the guide is to provide a level of knowledge to ensure contractors can be active participants in the construction AI conversation.

The guide describes uses of AI during the construction project lifecycle, including preconstruction, construction and building maintenance. It also provides definitions of terms, such as deep learning and predictive AI, as well as best practices in drafting office AI policies. - ABC National

OSHA’s final rule that expands the current recordkeeping requirements went into effect on January 1, 2024, and mandates the submission of Form 300-Log of Work-Related Injuries and Illnesses and Form 301-Injury and Illness Incident Report in addition to Form 300A-Summary of Work-Related Injuries and Illnesses data from construction establishments with 100 or more employees. Establishments with 20 to 99 employees continue to be required to submit only Form 300A-Summary of Work-Related Injuries and Illnesses data. - AGC National

ABC’s Construction Backlog Indicator Inches up in November, Contractors Remain Confident

Associated Builders and Contractors reported today that its Construction Backlog Indicator inched up to 8.5 months in November from 8.4 months in October, according to an ABC member survey conducted Nov. 20 to Dec. 4. The reading is down 0.7 months from November 2022. Despite the monthly increase, backlog is currently 0.8 months lower than at July’s cyclical peak. The sharpest declines over that span occurred among contractors with more than $100 million in annual revenues, who collectively reported fewer than 10 months of backlog in November for the first time since the second quarter of 2018. - ABC National
