Developers Plan $1B Data Center in Texas

OSHA has issued a final rule requiring personal protective equipment in the construction industry to properly fit each worker, effective Jan. 11. The regulation aligns with general industry and maritime standards, addressing long-standing safety concerns, particularly among women and workers with atypical sizes. Input, bid prices steady in November

Input and bid prices for construction remained stable from October to November, with the producer price index for new nonresidential building construction rising 1.5% year over year and the PPI for material and service inputs edging up 0.2%, according to the Bureau of Labor Statistics. Notable changes included a 21% year-over-year decrease in diesel fuel prices and a 15% increase in copper and brass mill shapes.

OSHA Launches Severe Injury Report Dashboard

On Sept. 4, the Occupational Safety and Health Administration unveiled its Severe Injury Report Dashboard, which gives users the ability to search its severe injury report database by year, industry, state, establishment name and type of injury. ABC is evaluating the dashboard to better understand its impact on construction employers. City of Dallas Inactive Permit Applications Cancellation � Sept. 1

The Planning and Development is implementing a system cleanup to improve efficiency and accuracy in their permitting process. As part of this process, they will be canceling permit applications that have been inactive for 180 days or longer.

Effective Sunday, Sept. 1, they will begin canceling permit applications in both Posse and Project Dox for which no submittals or resubmittals have been received.

To avoid the cancellation of your permit application, be sure to submit the required materials before Sept. 1. If your permit is canceled, you will need to reapply and pay all associated fees.

ABC, AGC and Other Trade Groups Seek Delay in New Ownership Reporting Rules

A coalition of over 100 trade associations - including both ABC and AGC - has asked Congress to delay the beneficial ownership information reporting requirement under the Corporate Transparency Act. The coalition argues that most small businesses are unaware of the new rules, risking significant fines. Sens. AGC Win in Joint Employer Case Becomes Final After NLRB Withdraws Appeal

The U.S. Court of Appeals for the Fifth Circuit on July 19 granted the National Labor Relations Board’s (“NLRB” or “Board”) motion to voluntarily dismiss its appeal of a district court’s order to vacate the Board’s 2023 “joint employer rule.” The vacatur was a major victory for AGC and its co-plaintiffs that initiated the lawsuit challenging the Board’s regulatory effort to broaden the standard for determining when an employer may be deemed a joint employer of another company’s employees. - AGC National

SCOTUS Overturns Chevron Doctrine, Limiting Federal Agency Reach

The U.S. Supreme Court overturned the Chevron doctrine on Friday in Loper Bright Enterprises et. al. v. Raimondo, Secretary of Commerce, et. al., in a blow to federal agencies.

The decision to nix Chevron could have massive implications for law enforcement by regulatory entities such as the U.S. Department of Labor, the U.S. Equal Employment Opportunity Commission, the National Labor Relations Board and the Office for Federal Contract Compliance Programs. - Construction Dive

Heat Stress Prevention

This course is intended for individuals that will be performing any duties on construction projects and jobsites. The course will assist them in better understanding the importance of noticing and preventing heat stress symptoms. Upon completion of this course, participants will have: an understanding of the sign and symptoms of heat-related disorders, predisposing conditions, likely causes, prevention and first-aid, in order to provide guidance and training to employees, as well as the ability to audit compliance with the HIPP.

Fed Has Ability to Lower Borrowing Costs Without Rate Cuts

The Federal Reserve has revised expectations for interest-rate cuts in 2024 to one from three, but the central bank has other, more subtle tools that could decrease rates to benefit businesses and households. The Fed can sway rates by communicating intentions, even without cutting its base rate. The yield on the 10-year Treasury has a strong influence on long-term loans and the yield declined from 4.7% in late April to 4.33% after the Fed's latest rate decision. Any further moves could affect conditions for borrowers. - The Wall Street Journal
