On July 2, 2019, Ontario’s Court of Appeal upheld Ottawa’s ability to mandate a federal carbon price ruling in a four-to-one judgement that Canada’s Greenhouse Gas Pollution Pricing Act is constitutional and that a “collective national response” is needed to reduce GHG emissions. This decision echoes the ruling of Saskatchewan’s top court last month on this issue. Premier Ford has vowed to appeal the ruling, joining Saskatchewan who is taking its challenge of the federal carbon tax to the Supreme Court of Canada. The CPA continues to press the federal government for the inclusion of propane as a clean fuel under this legislation.
