UPDATE – ON: Timeline for industry input has been extended for the new Hazardous and Special Products Regulation

Due to significant interest in the Ontario government’s draft administrative penalties regulation for Hazardous and Special Products (HSP), the timeline for industry input has been extended from November 1 until November 19, 2021.

Two hundred participants attended a webinar held on October 6 by the Ministry of the Environment of Ontario, Conservation and Parks (MOECP) who discussed the new enforcement tools for regulatory non-compliance of the Resource Recovery and Circular Economy Act, 2016.

The Resource Productivity and Recovery Authority (RPRA) is responsible for compliance and enforcement of the Act, including oversight of the producer responsibility framework. Despite repeated statements from the RPRA that they would be using communication and education tools to ensure regulatory compliance with the new HSP regime, the proposed regulation allows the RPRA to issue penalties to those that don’t comply with the law.

The CPA has been engaged with the RPRA and the MOECP to clarify compliance timelines and new penalties for obligated producers, proposed in the new Hazardous and Special Products regulation.

The CPA will submit comments reflecting member interests by the November 19, 2021 deadline and report back on any further program developments with industry impact.

Members are encouraged to provide input to either the RPRA directly, or to Marcelline Riddell, CPA’s Director of Government Relations for Ontario, by November 5, 2021.
