UPDATE – ON: CPA weighs in on 2022 recycling fees

On April 21, 2022, the CPA presented a proposal to the Resource Productivity and Recovery Authority on 2022 fees for refillable propane cylinders captured under the Hazardous and Special Products (HSP) regulation.

Approximately 15 staff and board members from the Authority’s Finance and Technology Committee attended the meeting, along with representatives from the Canadian Paint and Coating Association, Electronic Products Stewardship Canada and the Canadian Federation of Independent Business.

CPA’s Director of Government Relations for Ontario, Marcelline Riddell, provided the only formal presentation to the group, putting forward the case for lower category fees based on the sector’s high recycling rates and low administrative requirements. Riddell argued that fees for small producers should remain at $75 rather than $100 and suggested fees for large producers should be $500 instead of $1,000 as proposed. The presentation was well-received by board members. Other participating associations echoed the CPA’s call to base fees on services rendered rather than the proposed revenue model.

Producers obligated under the HSP Regulation (O. Reg. 449/21) of the Resource Recovery and Circular Economy Act (RRCEA), 2016 are required to pay fees to the Authority to fund its operations, including the costs related to building and operating the registry, compliance, and enforcement activities. Category E propane marketers have only two obligations under the HSP regulation: register with the Authority and collect and manage refillable propane cylinders they market in the province.

The Authority will consider all feedback received during this consultation to finalize the 2022 RRCEA program fees and the General Fee-Setting Policy. A report summarizing the consultation process, final fees and policy, Q&As from the webinars and feedback received in May 2022, will be posted on the Authority’s website.

The CPA will monitor further communication from the Authority and report back on whether the proposal for fee reductions for impacted members was effective.
