On June 12, 2019, Transport Canada (TC) published amendments (changes) to the Commercial Vehicle Drivers Hours of Service Regulations in the Canada Gazette, Part II (the Regulations). Currently, motor carriers and drivers maintain a daily log, but the amended regulations stipulate that these logs be replaced with electronic logging devices (ELDs) that have been tested and certified by an accredited certification body.
TC indicated that they would provide “a 24-month implementation period. During this time, companies that make or supply devices should prepare their devices and software to meet the new requirements. After this, they will need to be tested and certified.”
This means that by June 12, 2021 all federally regulated trucks will be required to install a TC-certified ELD in their vehicles. However, the deadline to comply is now less than nine months away and TC has yet to provide a list of TC-certified ELD platforms.
The CPA has communicated with TC expressing our concerns with this implementation date and that it is unrealistic to expect members to comply with the new amendments within a significantly shortened timeline, particularly considering that a list of TC-certified ELD platforms is still not available. TC indicated to the CPA that while they appreciate our concern, the minister was standing firm on the original timeline. The CPA maintained that the response provided is unreasonable and will continue to request a meeting with the Minister of Transportation to solidify the need to push the deadline back, both due to TC unreadiness, and due to COVID-19 delays.
