On November 1, 2021, Ontario’s Ministry of Transportation advised the industry that amendments to the Highway Traffic Act Regulation 555/06 were approved and will come into force on June 12, 2022. These changes will make it mandatory for commercial motor vehicle drivers who operate within Ontario to use an Electronic Logging Device (ELDs) to record their hours of service (HoS).
The CPA believes that the implementation timeline may be difficult for Ontario businesses to meet, given the experience of operators in preparing for the federal compliance of ELDs.
On November 19, 2021, CPA’s Ontario Government Relations Director, Marcelline Riddell, and Senior Vice-President of Regulatory Affairs and Safety, Rob Loenhart, met with Minister of Transportation Caroline Mulroney’s Associate Policy Director, Rob Elliot and Policy Assistant, Rhiannon Lloyd, to discuss latitude on implementation or enforcement measures.
Elliot and Lloyd said they appreciated learning about the issues facing fuel providers installing ELDs in their fleets. They also committed to reviewing the issue with internal staff and responding to the CPA on this request.
The June 12 enforcement date aligns with the roll out of ELD enforcement for federally-regulated commercial truck and bus carriers. Ontario’s ELD requirements closely match Transport Canada’s, including:
