Gov. Abbott Signs Key AGC Legislation into LawAfter the Texas Legislature adjourned sine die on May 31, Governor Abbott had until June 20 to sign or veto bills that made it to his desk. This session, our top priority was Senate Bill 219, which would make contractors no longer liable for design defects. This bill was signed into law on June 16 and is effective September 1, 2021. Other notable priority bills that were signed into law are: Senate Bill 338 – Creating uniform general conditions (UGCs) for K-12 building construction; House Bill 3069 – Shortening the statute of repose for public work to 8 years plus 1 year to sue; House Bill 2416 – Closing the commercial general liability coverage gap for attorney’s fees; and Senate Bill 968 – Language that keeps construction open and essential during a pandemic. AGC Action AlertAs construction materials remain at record high prices and face continued availability challenges, President Biden and Congress are taking actions to make things worse. Meanwhile, construction firms around the country are absorbing these costs — which would better be invested in recruiting and retaining construction workers — without significant relief in sight.
