AGC Houston accepting applications for Leadership AGC Class of 2017 In 2015, AGC Houston launched an immersive development program that helps participants become transformative leaders. To date, close to 30 individuals—earmarked by their companies as up-and-coming leaders—have taken the interactive course. During the eight-month program, participants gain a better understanding of the responsibilities and qualities that leaders need to successfully shape AGC and the Houston commercial construction industry. AGC Houston is now accepting applications for the 2016-2017 session, which begins in September. A limited group of 20 participants will be chosen for the class of 2017.

The U.S. Supreme Court issued a ruling that will allow the construction and development industries with a way to respond immediately to overly aggressive assertions by the federal government that the property they want to build contains jurisdictional "Waters of the United States" (WOTUS).
GC was the only trade association to advance the commercial construction industry’s interest in the outcome of this case and, once again, AGC has succeeded in changing facts on the ground. This decision will have a material impact on the way that the Section 404 permit program actually functions.

Construction employment dipped for the second consecutive month in May, but rising industry pay and plunging unemployment suggest contractors would be hiring more workers if they were available, according to an analysis by the Associated General Contractors of America. Association officials cautioned that worker shortages may be reaching the point where they undermine the sector’s growth.

Congratulations to James D. Wofford Jr., AIA has been named Executive Director, Facilities Planning and Construction for the University of Houston System and the University of Houston. As Executive Director, Wofford looks forward to providing leadership and direction to Facilities Planning & Construction. He will manage the department’s budget and human resources while maintaining direct responsibility and monitoring of the university’s activities pertaining to long range planning and facilities development. This will include the construction of buildings, utilities, site work and renovation/remodeling projects at the University as well as the component campuses. Wofford began his career managing corporate projects as part of Houston Lighting and Power Company's Architecture department. Most recently, he was a senior manager for the Jones Lang LaSalle projects group at the ExxonMobil Houston campus. Houston foundation repair company pays nearly $100K in back wages, liquidated damages to 30 workers after U.S. Labor Department investigation A U.S. Department of Labor Wage and Hour Division investigation found MMM Foundation Repair violated the overtime and record-keeping provisions of the Fair Labor Standards Act. Investigators determined the employer misclassified employees as independent contractors, and paid them flat-day rates without regard to how many hours they worked. Violations resulted when these employees worked more than 40 hours in a week and the employer failed to pay them overtime. MMM Foundation Repair also failed to keep time or payroll records for some employees, as required by FLSA. The resolution? MMM Foundation Repair paid $49,980 in back wages and an equal amount in liquidated damages, for a total of $99,960 to 30 employees. The company also agreed to keep proper records and comply with all provisions of the FLSA in the future. In 2014, President Obama directed the Secretary of Labor to update the overtime regulations to reflect the original intent of the Fair Labor Standards Act, and to simplify and modernize the rules so they’re easier for workers and businesses to understand and apply. The department has issued a final rule that will put more money in the pockets of middle class workers—or give them more free time. The U.S. Department of Labor's Occupational Safety and Health Administration today issued a final rule to modernize injury data collection to better inform workers, employers, the public and OSHA about workplace hazards. With this new rule, OSHA is applying the insights of behavioral economics to improve workplace safety and prevent injuries and illnesses. AGC Houston member Tony Stergio, Andrews Myers, PC writes about the effect these new regulations will have on employees and employers.
