Release of Integrated Review Plan for the Ozone National Ambient Air Quality Standards

SUMMARY:
On or about August 26, 2019, the Environmental Protection Agency (EPA) will make available the final document, Integrated Review Plan for the Ozone National Ambient Air Quality Standards (IRP). This document contains plans for the current review of the air quality criteria and national ambient air quality standards (NAAQS) for photochemical oxidants including ozone (O3). The primary and secondary O3 NAAQS are set to protect the public health and the public welfare from O3 and other photochemical oxidants in ambient air.

Deepwater Port License Application: Bluewater LLC; Extension of Scoping Period

SUMMARY:
By Federal Register notice of Wednesday, July 3, 2019, titled Deepwater Port License Application: Bluewater Texas Terminal LLC (Bluewater), the U.S. Coast Guard (USCG), in coordination with the Maritime Administration (MARAD), announced the intent to prepare an environmental impact statement (EIS) as part of the environmental review of the Bluewater Texas Terminal LLC (Bluewater) deepwater port license application. Publication of that notice began a 30-day scoping process, announced the date and location of a public scoping meeting as well as requested public participation to assist in the identification and determination of the environmental issues to be addressed in the EIS. This extension is due to delays in getting the application properly posted to the Federal docket. This Federal Register Notice announces the date of the extended scoping period.

Significant New Use Rules on Certain Chemical Substances

SUMMARY:
EPA is issuing significant new use rules (SNURs) under the Toxic Substances Control Act (TSCA) for 145 chemical substances which are the subject of premanufacture notices (PMNs). The chemical substances are subject to Orders issued by EPA pursuant to section 5(e) of TSCA. This action requires persons who intend to manufacture (defined by statute to include import) or process any of these 145 chemical substances for an activity that is designated as a significant new use by this rule to notify EPA at least 90 days before commencing that activity. The required notification initiates EPA's evaluation of the use, under the conditions of use for that chemical substance, within the applicable review period. Persons may not commence manufacture or processing for the significant new use until EPA has conducted a review of the notice, made an appropriate determination on the notice, and has taken such actions as are required by that determination.

This rule is effective on October 21, 2019. For purposes of judicial review, this rule shall be promulgated at 1 p.m. EST on September 3, 2019.

The Environmental Protection Agency is planning to submit an information collection request (ICR), “Reformulated Gasoline and Conventional Gasoline: Requirements for Refiners, Oxygenate Blenders, and Importers of Gasoline; Requirements for Parties in the Gasoline Distribution Network” (EPA ICR No. 1591.27, OMB Control No. 2060-0277) to the Office of Management and Budget (OMB) for review and approval in accordance with the Paperwork Reduction Act (44 U.S.C. 3501 et seq.). Before doing so, EPA is soliciting public comments on specific aspects of the proposed information collection as described below. This is a proposed extension of the ICR, which is currently approved through 5/31/2020. Clean Water Act Hazardous Substances Spill Prevention

SUMMARY:
The Environmental Protection Agency (EPA or the Agency) is not establishing at this time new requirements for hazardous substances under Clean Water Act (CWA) section 311. This section directs the President to establish procedures, methods, and equipment and other requirements for equipment to prevent discharges of oil and hazardous substances from vessels and from onshore facilities and offshore facilities, and to contain such discharges. The EPA has been delegated and/or redelegated authority for certain facilities as identified below. On July 21, 2015, a lawsuit was filed against the EPA for failing to comply with the alleged duty to issue regulations to prevent and contain CWA hazardous substance discharges under CWA section 311. On February 16, 2016, the United States District Court for the Southern District of New York entered a Consent Decree between the EPA and the litigants that required a notice of proposed rulemaking pertaining to the issuance of hazardous substance regulations, and a final action after notice and comment. After seeking public comment and based on an analysis of the frequency and impacts of reported CWA Hazardous Substances discharges, as well as the existing framework of EPA regulatory requirements, the Agency is not establishing at this time new discharge prevention and containment regulatory requirements under CWA section 311.

On May 22, 2019, the U.S. Environmental Protection Agency (“EPA”) published an entry in the Spring 2019 Unified Agenda of Regulatory and Deregulatory Actions announcing that EPA will review the rulemaking “Regulation of Fuels and Fuel Additives: Changes to Renewable Fuel Standard Program” pursuant to section 610 of the Regulatory Flexibility Act. The purpose of this review is to determine if the provisions that could affect small entities should be continued without change, should be rescinded, or amended to minimize adverse economic impacts on small entities. The entry invited public comment on this proposal via the established docket on Regulations.gov by August 22, 2019—90 days after publication of the Spring 2019 Unified Agenda of Regulatory and Deregulatory Actions. On August 15, 2019, EPA received a request from the Small Refiners Coalition to extend the comment period by 30 days to allow its members to provide thorough comments and data. On August 16, 2019, EPA received a similar request from the Small Retailers Coalition. EPA is extending the deadline for written comments an additional 30 days to September 23, 2019.
