ILTA Developing Working Group on EPA Gasoline Distribution Issue
Recently, the Environmental Protection Agency was sued for missing a technology review deadline on three respective gasoline distribution rules: 40 CFR Part 60 Subpart XX, Part 63 Subparts R and Part 63 Subpart BBBBBB (6B). These rules are now subject to a court-ordered consent decree that requires proposed rulemaking by the end of 2021 and final rulemaking by the end of 2022.
Over the last few months, the agency has been in preliminary talks with the American Petroleum Institute and ILTA, seeking guidance and technical expertise before releasing its proposed rule later this year. Early discussions, however, have signaled that EPA’s proposal will be far reaching and could result in significant added costs for some terminal operators. In order to better inform EPA’s experts, ILTA has started a working group dedicated to this gas distribution rule review with consulting support from Rob Ferry and Earl Crochet.
The group held a planning meeting on August 27 and a follow-up technical discussion on September 2 with members to develop a letter to send to EPA regarding industry concerns. ILTA and API are also meeting with EPA on September 8 to discuss the rulemaking.
