Good Afternoon Wayne,

I am a mechanical contractor in the commercial and institutional sectors. We are experiencing unprecedented price volatility and availability of mechanical equipment. These issues impact the foundation of our bids. Do you have other members expressing the same concerns?  Do you have strategies to mitigate this risk?

Signed,
Mitigating Risk

Dear Mitigating Risk,

You are not alone. Contractors and manufacturer reps across the province and nationally are expressing the same concerns. In fact, supply chain issues and price volatility dominated the MCAM board of directors meeting in January 2021. It is an issue that is not isolated to mechanical contracting, but rather the entire spectrum of the construction industry. I would highlight the May 2021 Winnipeg Construction Association Practice Bulletin #4, which recommends a “…bid irrevocability period of 15 day with a maximum of 30 days…” It is important during this time to share this recommendation with owners and their representatives. Further I highlight the webinar hosted by the Mechanical Contractors Association of Canada in April of 2021, Managing the Risk of Price Volatility and Supply Chain. The webinar features Dan Leduc of Norton Rose Fulbright as he provides “insight on how MCA Canada members can try to contractually manage the risks of price volatility and supply chain issues.” The webinar may be found by clicking the button below.

Dan Leduc practices primarily construction law and dispute resolution. He is frequently called upon to advise and represent owners, subcontractors, suppliers and builders in such front-end services as contract review, tender issues and general construction matters, as well as in litigation and arbitration.

Signed,
Wise Wayne
