Motor vehicle collisions is the #1 cause of employee fatalities (OSHA) and distracted driving is now one of the most significant contributing factor to these collisions. Could your company be liable? According to the National Safety Council's 2014 Injury Facts, the three biggest causes of fatalities on the road include:
Each year thousands die needlessly because people continue to use their cell phones. Using a cell phone while driving makes it four times as likely that you'll crash - while using either handheld or hands-free devices. The cost to employers of distracted driving crashes is high - not just in lives lost, healthcare costs, and vehicle repair costs, but in the millions of dollars paid out in liability cases. The annual cost of crashes caused by cell phone use is estimated at $43 billion or approximately $120 million every single day of the year (Harvard Center for Risk Analysis).

Employers can be held liable if a driver responsible for a crash was using an employer-owned or personal cell phone. In the past ten years, distracted driving crashes have resulted in companies paying millions in restitution, ranging from $1.5 to $24.7 million, to victims injured by negligent driving of an employee distracted by a cell phone.
