AGC of America became a signature supporter of National Construction Safety Week in 2019. As part of that effort, we encouraged member firms to get involved in and help organize National Construction Safety Week events in May. The Utility Infrastructure Division (UID) has published its, Elements of an Effective Underground Utility Safety and Damage Prevention Program. The document, developed in concert with AGC’s  Highway & Transportation Division, will help contractors improve and memorialize their overall underground utility safety and damage prevention/811 program.  Multiple resources have been assembled to help improve safety, protect underground utilities and provide ways and means to keep a reliable program record.  This will help contractors gauge their program’s effectiveness, keep track of other stakeholders’ veracity in performing their responsibilities, structure data reporting and provide the wherewithal to defend against sometimes frivolous utility damage claims and collection activities.

In addition, the UID has selected Compatica’s Worksite Incident Recording and Management Application to complement the program. Compatica’s solution will help contractors memorialize all aspects of the 811 process in the field, enabling them to gauge their programs' effectiveness, record the circumstances of a damage or near miss and defend against frivolous claims.  Compatica is an AGC partner with substantial discounts for AGC members.

The U.S. Department of Labor has selected Scott Ketcham as the new director of the Occupational Safety and Health Administration’s (OSHA’s) Directorate of Construction (DOC) in Washington, D.C. Ketcham had served as deputy director of DOC since February 2017.

The U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA) has finalized its June 27, 2017, proposal to revise the construction and shipyards standards. In the final rule, published on September 30, 2019, OSHA: 

• Does not implement the proposal to revoke all of the standards’ ancillary provisions; but

• Extends the compliance dates for the ancillary provisions to September 2020 to account for OSHA’s new proposal to revise or remove specific provisions; and

• Maintains enforcement of the permissible exposure limit.

The U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA) announced that it has recently implemented the OSHA Weighting System (OWS) for fiscal year 2020. OWS will encourage the appropriate allocation of resources to support OSHA’s balanced approach of promoting safe and healthy workplaces, and continue to develop and support a management system that focuses enforcement activities on critical and strategic areas where the agency’s efforts can have the most impact.
