The federal government has filed a motion in that court to dissolve the current stay of any enforcement of that standard, including its vaccination/testing mandate, and on December 10, the parties will complete their briefing of that motion. Since November 6, that stay has precluded OSHA from implementing or enforcing the ETS, including requirements that OSHA had scheduled to take effect on December 6. AGC of America expects the court to grant or deny the government&rsquo;s motion within a matter of days. While significant, the court&rsquo;s decision will not end the litigation. Its decision on the stay will not be a final decision on the merits of the ETS. That will come later.</div> <div>&nbsp;</div> <div>The Sixth Circuit is considered one of the more conservative courts. Republicans nominated 11 of its members and Democrats nominated only 5. If the Sixth Circuit nevertheless dissolves the stay, OSHA will have the authority to immediately begin implementing and enforcing the ETS. At that point, one or more of the petitioners is, however, likely to go to the Supreme Court, seeking an emergency order to reinstate the stay.</div></p> 12/16/2021 11:52:52 AM https://www.naylornetwork.com/ngc-nwl/articles/index-v3.asp?aid=706724&amp;issueID=80923 Field-to-Office Communication Essential to Project Schedule and Budget https://www.naylornetwork.com/ngc-nwl/articles/index-v3.asp?aid=706719&issueID=80923 <p><strong style="font-size:10px;"><a href=https://www.naylornetwork.com/ngc-nwl/newsletter-v3.asp?issueID=80923>December 2021</a> -- <em>CONSTRUCTION TECHNOLOGY NEWS</em></strong><br /><div>Good communication between the field and office is essential to keeping a project on time and on budget. But, in an information-intensive industry like construction, paper documents are often a hazard since they can disappear and be difficult &mdash; or impossible &mdash; to locate, share or distribute in their correct, most recent version. The COVID-19 pandemic forced many firms to switch to a Work from Home (WFH) environment. While the construction phase by nature requires on-site presence, the construction management, engineering and procurement teams working on pre-construction phases have switched to a mostly decentralized workforce. This novel setting resulted in the exploration of new avenues for the quality management aspect of project execution. Since the poor quality of pre-construction phases will eventually find its ways to the construction phase, it is imperative for project participants to make necessary adjustments to keep quality in the forefront of execution.&nbsp;</div> <div><em>BY HOUMAN PAYAMI.
