On Saturday, September 26, President Donald Trump nominated Judge Amy Coney Barrett to fill the seat on the Supreme Court vacated by the passing of Justice Ruth Bader Ginsberg. Beginning the confirmation process by mid-October will allow Republicans to fill the seat before the November 3 election. NRMCA has applauded President Trump’s policy of nominating judges in the mold of late Justice Antonin Scalia, for whom Judge Barrett clerked, with a skeptical view of the administrative state and broad reaching actions by the Executive Branch. NRMCA will be paying close attention to the confirmation hearings and process to determine how Judge Barrett’s decisions may impact issues important to the ready mixed concrete industry. The Senate is set to vote on the House-passed continuing resolution (CR) to fund the government through December 11 as well as extend the FAST Act and the National Flood Insurance Program for one year. The legislation will provide a $13.6 billion transfer from the general fund into the Highway Trust Fund, providing $10.2 billion to the Highway Account and $3.4 to the Mass Transit Account. NRMCA and PCA will host a joint government affairs meeting on Tuesday, October 13, at 2 p.m. Eastern time. Make plans to attend this meeting for an update on what’s going on in Washington along with NRMCA and PCA’s positions on industry priorities. This year’s ConcreteWorks will have a strong focus on government affairs; the opening general session will be an election and political update with Charlie Cook, and the second general session will be a presentation on how the election could impact the cement and ready mixed concrete industries. While there have been reports that House Speaker Nancy Pelosi (D-CA), White House Chief of Staff Mark Meadows and Secretary Treasury Steve Mnuchin have resumed talks, the House has begun to prepare for a vote on a new $2.4 trillion relief package. The House previously passed a $3 trillion package in May, but negotiations between Congressional Democrats and the White House broke down in August over the ultimate price tag of the legislation as well as the terms of unemployment compensation and liability protections. NRMCA continues to advocate for an additional COVID-19 package including reforms to the Paycheck Protection Program (PPP), emergency funding for state departments of transportation to reinstate canceled and delayed projects, and liability protections for businesses operating through and after the pandemic. Earlier this week, NRMCA and a broad coalition of small business groups sent a letter to Congressional leadership supporting Rep. Jamie Herrera-Butler’s (R-WA) procedural effort to force the House to consider a bill that would allow hard-hit businesses to take a second round of PPP; streamline forgiveness for loans under $2 million and allow 501(c)6 non-profit organizations to access PPP loans.
