The Coalition for a Democratic Workplace (CDW) provided the following update regarding a recent decision of the National Labor Relations Board (NLRB) impacting the remedies available to workers who have been determined to be wrongly fired or disciplined: On December 13, the NLRB issued its decision in Thryv, Inc., a case dealing with consequential remedies for workers. The decision expands the “make-whole remedies” available to workers who have been fired or disciplined in violation of the NLRA even though the NLRA does not provide the Board with the authority to award consequential damages. Remedies can now include “all direct or foreseeable pecuniary harms” that stem from the illegal discipline, such as medical bills or credit card debt a worker accrued after losing their job. CDW filed an amicus brief in the case and issued a statement criticizing the Board for pursuing this policy. As we explain in the brief, “the introduction of consequential damages, and the resultant need to prove the causation and reasonable foreseeability of such damages, will increase and prolong litigation,” and “efforts to recover such damages in the course of trying to settle claims will result in a failure of settlement when respondents have no opportunity to test the propriety of such damages through contested proceedings.” NRMCA is an active member of the CDW, joining with hundreds of business organizations to advance ready mix friendly policy. The NRMCA Promoter of the Year Awards for Buildings and Pavements recognize the contributions and promotional efforts of individuals from the ready mixed concrete industry. Nominees must be employees of an NRMCA Producer member and must have worked in the industry for at least five years.The State Affiliate Promoter of the Year Award recognizes outstanding concrete promotion contributions by an employee of one of NRMCA’s state affiliate partner organizations. Nominees must be current employees of a state affiliate who have worked in the industry for at least five years. Please submit a nomination of no more than two pages, detailing the nominee’s promotional efforts over the last five years with particular emphasis on contributions during the past 12-18 months in some or all of the following performance categories:
The John Roberts Lifetime Achievement Award for Promotion is awarded to a concrete professional distinguished by a career that demonstrated outstanding leadership, dedication and achievement in support of concrete promotion and industry advancement. Nominees for this award must be former employees of NRMCA member companies who are now retired or deceased. Build With Strength’s Director, Building Innovations, Brandon Wray, presented at three separate events last week to a total of over 1,200 attendees. The first topic, Embodied Carbon: Deeper Decarbonization of the Built Environment, was presented jointly with the New Buildings Institute (NBI) and Buro Happold. The second, Economic, Sustainable, and Resilient Design of ICF Walls, was targeted for the National Council of Structural Engineering Associations (NCSEA) and presented by Wray and his BWS colleague, Donn Thompson, senior director, building innovations. Lastly, Wray and Evan Reis from the U.S. Resiliency Council (USRC) presented Resilient Design: Performance of Structural Materials to the Structural Engineering Association of Southern California (SEAOSC). Sustainability, Resiliency, and Insulated Concrete Forms (ICF) represent three of the most prominent topics regarding concrete materials and construction in the present day design build environment. Developers, architects and engineers, along with local, state and federal government groups, are all vying for strategies to tackle climate change through reducing the embodied carbon of the built environment. NRMCA and Build With Strength continue to be a prominent expert resource for the industry in guiding stakeholders to strategies and processes to advance concrete as the preferred sustainable and resilient building material. NRMCA's Ready Mixed Concrete Delivery Professional Driver of the Year Award, now in its 27th year and sponsored by the Truck Mixer Manufacturers Bureau (TMMB), acknowledges the significant contribution of ready mixed concrete truck drivers to the growth and success of individual companies and the ready mixed concrete industry. As a salute to these key members of the concrete production and delivery team, the award recognizes the driver’s career achievement, safety, professionalism, competence and customer service skills in a manner that will enhance the industry and public image of the career of Ready Mixed Concrete Delivery Professional.
