On November 10, 2023, the Supreme Court of Canada (“SCC”) released its highly anticipated decision on Ontario (Labour) v Sudbury (City). On appeal from the Ontario Court of Appeal (“ONCA”), previously analyzed by McMillan LLP, the SCC reviewed the intertwined occupational health and safety duties of owners, constructors, and employers on construction sites. In doing so, the SCC let stand the ONCA finding that an owner, even if their role was limited to occasionally having employees on site for quality assurance, has equal responsibility and liability under the Ontario Occupational Health and Safety Act (“OHSA”) as the constructor with whom the owner contracted to oversee the project in the first place.

Infrastructure Ontario (IO) has awarded the contract to Colliers Project Leaders to become IO’s new Project Management Service Provider (PMSP). Colliers was selected to provide the best-in-class project management and program management services for the Ontario Ministry of Infrastructure’s General Real Estate Portfolio (GREP).

The Progressive Contractors Association of Canada (PCA) and CLAC are cordially inviting OGCA members to the Queen’s Park evening reception on Monday November 20th.

CCA has new CCDC documents coming soon, along with new order forms!

Funded in part by the Government of Canada’s Sectoral Workforce Solutions Program, the Canada Green Building Council (CAGBC) in partnership with the Canadian Construction Association (CCA) has developed the Building Skills for Climate Change: Low-Carbon Training Program. This program is aimed at upskilling building professionals, including architects, engineers, contractors, and owners and operators, to accelerate the adoption of low-carbon practices, reduce emissions, and contribute to Canada’s Climate Action Plan and Just Transition.

The RBC Climate Action Institute released its newest report, Timber Rising: How Wood Can Spur Canada’s Green Building Drive.

This report lays out the barriers and opportunities of scaling mass timber as a low-carbon alternative to concrete and steel in construction. With widespread adoption, mass timber has the potential to cut sector emissions by nearly 10%.

Bill 79 amends various work-related statutes including, the Employment Standards Act, 2000, Occupational Health and Safety Act, Employment Protection for Foreign Nationals Act, 2009, Fair Access to Regulated Professions and Compulsory Trades Act, 2006, Ministry of Training, Colleges and Universities Act, Ontario Disability Support Program Act, 1997, and the Ontario Works Act, 1997.

On November 6, 2023, the Government of Ontario announced it will introduce legislation which, if passed, will require an employer to disclose (a) an expected salary range in any job posting, and (b) whether artificial intelligence is used in the hiring process. The government further announced it will conduct consultations on ending the use of a non-disclosure agreement in the settlement of a case of workplace sexual harassment, misconduct, or violence.
